Hi all,


I just filed my i-130 petition couple of weeks ago, and I received the NOA1 hardcopy early this week. I was wondering, is it smart for me to file a k-3? The reason I am seriously considering k-3 is I see a lot of people waited so long for NOA2 and never get a response, it is free to file, and seems like there is no harm into it, what is your opinion on k-3?


Also, if I do decide to file k-3, do I need to file on same evidence level as i-130?

K3 is a decent decision to make if the local office is slow. But that doesn't mean it will hurry either decision and may slow it down as well. As a petitioner you send the I-129F with the copy of the NOA1. It becomes a K3 if an approved I-129F makes it to the NVC before the approved I-130. Sometimes a consulate will close the K3 path if there is an approved I-130 on file (look up member EmilyS.)

But you can try, there's nothing to say you can't, just make sure you fill out your timeline accurately if you do happen to proceed with the K3 because it is rare. :)

In the end it's more expensive because the beneficiary has to adjust status in the USA to get the green card.

Is Not much of a difrence originally the k3 was for bringing your relative faster because the i130 in the past it was a long wait now is not like that ij my opinión the k3 is more expensive and obsolete
