Good day everyone!

I have a couple questions regarding green cards. The person I know is Canadian and she has F-1 status(international student visa). She married a U.S. Citizen and wants to adjust her status to a green card holder. Now her husband does not make enough to support her so her father-in-law said he will do it... Her father- in-law is LEGALLY married however they are and have been for 13 years living separately BUT they file joint tax returns.

1. Can only her father in law fill out and file the affidavit of support or does her mother in law need to as well? Does the mother in law need to know about her legal husband filling for this?

2. If the person has worked under the table as a nanny does she need to state this on her application? WIll she be denied her application? Will she get into trouble?

Timeline

Never lie to immigration, if they find out later then can revoke all status you have gotten. As long as no false claim to USC was involved usually you are scolded if you married a USC nothing more.

This will not be over quickly. You will not enjoy this.

under no circumstance must a person put that they are working in the US, especially if they are not authorized to do so! DONT PUT IT!

What? So it is ok to lie on the forms, hoping that USCIS won't know?

Potential Immigrant will undergo background check, hence USCIS will discover the truth sooner or later.

By the way, illegal employment is 'forgiven' for marriage-based Adjustment of Status applications while misrepresentation is not.

If you don't list the jobs, and USCIS discovers them, you could be found guilty of material misrepresentation, and barred from the US for life.

Ok thank you everyone! She does not want to lie and a lawyer suggested to do so! So glad She did not listen to him! However she is a nanny and worked under the table.. When she applies she will be unemployed as she no longer works. Do you think this will affect the out Of the green card application? Also she does not want to get her employers in trouble.. Will they get into trouble if she says who she worked for as a nanny?
