Is VWP ban automatic,or at discretion of entry officer?

If someone is denied an AOS request while on VWP, is future VWP entry automaticly denied,or is it at the discretion of the immigration officer at POE?

Also, would immigration know about the attempted AOS right away,or would it most likely be found out only if there was secondary questioning at POE?

As long as you leave within your 90 days you are still VWP eligible.
