My 16 years daughter got her interview in cd Juarez ,got her visa denied for admit to use marihuana in the past,the officer give her one year ban ,she will be available until may 2014,she came to the USA when she was only 2years old,now we have to stay separate for a year :( anybody been in same situation ,thanks for any advise!!

I'm sorry this happened to you.

I would recommend against spending any real money on lawyers or anything trying to overturn this. The consular officers have extremely powerful discretion here, and overturning this will be next to impossible. Even if you have some grounds for appeal, the process will be very, very expensive and take most of the next year anyways.

A one year ban is actually comparatively light. I think the rules may have recently changed, allowing such a short ban. I've seen bans for drug use of 2 years or longer, real often.

Your main priority is to make sure your daughter has a place to stay and support, and is in a social or family context that will make it as easy as possible for her to stay clean for the next year. Her next medical will be looking very very carefully at any drug use (including blood tests) and if she gets caught having used drugs at the next medical, I guarantee you the next ban will be significantly longer than a year. It could even be permanent, and this needs to be made very, very clear to her.

Thank you so much for your advise,I'm thankful to God to have a big family,they are really good take care of her,she is having hard time to learn the language and the weather but other then that she will be just fine,me and her Lil sisters missing her too much and I just pray to god to keep me strong and time goes fly fast, I'm sure she will keep her self clean of drugs,she learn her lesson,in the hard way but after this she will become a better person,thank you :)

I would like to ask you something. when was last time that your daughter used marihuana?

Did they realized by laboratory test?

Dana, besides the 1-year ban the consulate will require that she be tested every three months to confirm she is not using, still. She must have been given the details so make sure you go over them with her. There is more to it than just waiting a year and reapplying. She will need to prove she remains clean for a year, as well.

A lawyer will not help because her case is textbook and there are no appeals against a positive drug test, even for marijuana.

I am not sure either. I have read somewhere THC remains in the body for about 2 weeks (don't quote me on that) so the three-month interval would be a fair indicative of one's ability to stay away from marijuana.

The officer didn't give my husband any instructions,all he told him ,she has to wait a year and then come back after the year is up and redone her physical again, when I called the embessy and ask them, they say when the times come they will send me instruccions what to do next :(

How did they realize about the drug abuse? The lab exams showed it?

My husband admitted to using marijuana and got a one year ban too, he was never told about getting checked every three months. He just has to wait until february 2013 to go get an exam again. I will let you know how our case turns and what they ask him so you can know what follows. good luck on your case I know its hard being away from your love ones

Hello,

I am sorry to hear about the complications you went through as I am currently going through it myself with my husband's case. As I see your timeline, I believe your ban is over (hopefully!) therefore I would like to ask what the next step was after the ban was lifted? Any help would be appreciated. My husband's ban is up until January 2016 and no other information was provided to us. Will we have to re file everything all over again?

Hi , my daughter been back home since July 2014, you dont have 2 file anything just to wait his year is been up and then contact them again they will send you a paper you have to fill out and send it back so they can set up his appointment again;with my daughter we have to payed her medical again, good luck

After her year was up we contact cd juarez consul and they send me the paper right away and we send it back soon as posible on email, after that we was ready to set up her next appointment really quick

Dana, I am so happy for you and your daughter. Glad this nightmare is over for you!! What kind of appointment did she go to? Was it to the consulate or just for the medical exam? Also, did she have to be tested throughout the year to prove to the consulate that she was clean? How did you contact the consulate when the ban was up? Did you email or call? I am sorry for all the questions but I emailed the consulate 2 weeks ago asking everything I pretty much have asked you and still have no response. I haven't been able to find a direct number for the consulate. I did call the NVC but since the case is at the consulate they told me I need to contact them directly. I thank you so much for your response as I know a lot of people rarely log back in here after their case is complete. I really appreciate it.
