typographical error by the uscis

Hello everyone,

My wife received her work permit/travel document "combo card" in the mail today. That was great news! However, in looking at her full name on the back of the card, I found that they misspelled her middle name. They put "De Mxxxx" instead of "Di Mxxxx." On the front of the card, they only list her middle initial of "D," which is fine.

I called the 800 number and told them about the error. He basically told me that I need to send the card back, resubmit the I-765 and I-131 applications, explain the error, etc. I asked him how long it'll take to get a new card and he told me that I have to wait the normal processing times again.

Really?!

They misspelled 1 letter. It was clearly their fault because it was spelled "Di" everywhere else (on our initial applications, on their NOA documents, on the biometrics appointment letter, etc). Cannot they just go back and look at all the documentation that they have, realize they messed up, and send us a new card in, say, a few days?

Keep in mind, we need to fly back to Italy in late August to make the final preparations for our religious ceremony, so we can't wait another 3 months for them to correct their mistake.

Has anyone else gone through a typographical error correction process? Any help or info will be greatly appreciated!!!

On a sidenote, I have already scheduled an Infopass appointment in 10 days (that was the earliest), so I hope that can shed some positive light on all of this.

On another sidenote, I had an idea. Would it hurt to just go with it and use "De Mxxxx" as her legal (middle) name at this point? We'll put "De" on her social security card and driver's license, so all of her USA identification will actually match. My wife said she would go with it if it'll work and we don't have to jump through all the these hoops.

Any thoughts???

I wouldn't just change her name on the other documents - theirs was a mistake, but I wonder if yours would be misrepresentation. Furthermore, the name on the AP would need to match the name on her passport.

"Replacing an EAD

A replacement EAD replaces a lost, stolen, or mutilated EAD. In addition, an EAD may be replaced without fee for USCIS error when it was issued with incorrect information, such as a misspelled name. You must file Form I-765 to replace an EAD"

Some will likely tell you to get it fixed and it would probably be the safest route to go. She could get hemmed up in immigration by an IO who has nothing better to do.

My concern with changing the name on all her future documents would be that it won't match her passport or BC and could cause an issue with ROC or Naturalization if she goes that route.

My personal opinion? My wife's GC came back and had her listed as male. When faced with the thought of trying to get it changed we chose to let it slide. She's gone through US immigration several times with it and it's never been caught. That's not to say it won't ever be an issue but we decided to take the chance.

Thank you! After thinking about it, I feel it is best to get it changed so we know it's truly accurate.

Two more questions:

1) If we re-file form I-765, do we need to include all the backup documentation again, or can we simply send in the form by itself? After all, it's not the backup that's the issue, it's just a typo.

2) Do we need to re-file form I-131 as well? Or will the Service Center make the corrections on everything by us sending in the I-765 and re-issue the combo card with the correct name?
