I have been reading a lot of these posts, and it says that the NVC is supposed to send me a form for me to fill out and that will generate an invoice for a fee.... soo, it has been almost 2 weeks since my approval at USCIS, and havent heard anything yet from NVC... I called yesterday, and after on hold for 20 mins, they said that the case was already sent to the Embassy. My question is when will I have to pay the fees, or receive paper work for AOS?

I love me some him....

Your post is confusing to me, but I'll try to give a brief explanation of the K-1 process and see if that helps:

1) USC files 1-129F petition with USCIS along with the original fee (currently $340)

2) USCIS Receives petition you get NOA1

3) USCIS Approves petition you get NOA2

4) USCIS sends I-129F to NVC

5) NVC logs it in and assigns it a consular case number

6) NVC sends the petition off to the embassy where the beneficiary will file for the actual K-1 Visa

7) Embassy receives petition and logs it into their system

8) Embassy requests proper forms from Beneficiary be filled out and returned

9) Beneficiary gets forms filled out and returned

10) Beneficiary gathers all necessary support documentation including Police certificates, Medical, I-134 from petitioner and any other supporting documents required for the embassy

11) Interview scheduled with Embassy

12) Payment of fee either before interview or at the interview depending upon the embassy rules for your particular embassy

13) Interview (hopefully successful)

14) Embassy sends back passport with Visa

15) Come to America.

Does that make sense?

I think you're mistaking the process for K1 (for Fiancé) with the I-130(for Married couple). Once you submit the application for a fiancé and it's approved, the rest of the steps are completed at the embassy unlike the I-130. I think UK-USA-K1 did a great job of listing the steps involved for K1. Congrats on the approval and good luck!

K1 - Filed March 2011

- Denied March 13, 2012

- Placed in AP March 14,2012

- Sent back to USCIS November 2012

- Expired March 2013

WASTED A YEAR FIGHTING THE DENIEL

MARRIED MARCH 15, 2013

1-130 Approved 3/3/2014 :-)

Finally made it home 3/18/2014

for k-1's, the file, after the approval, goes to NVC, NVC assigns a case number and then they send it to the Embassy. What you were saying about sending you a form and generating an invoice, those are only for IR-1/CR-1(spousal visas), like others have said.

Good luck at the interview! star_smile.gif
