Pending I-130 for stepson, Visa waiver program, & adjustment of status

Hello!

I am a USC and have a pending I-130 app for my 15 yr old German stepson (still waiting for NOA-2). The USCIS told me he could come visit through the Visa waiver program and if his application moved to the NVC we could ask to interview here instead of consular processing. Would it also be possible to apply for adjustment of status during those 90 days? From what I read, since he is an immediate relative and an unmarried child, he would be eligible for AoS as long as he is physically present in the US and has an 1-130 app submitted. Does anyone have experience with this?

Using VWP or tourist visa with intent to AOS is immigration fraud.
