I am USCitizen and my wife is Indian citizen (Married in 2010 Aug). She has been in Germany since '09 for her PHD. She is finishing by Dec 2013, hence we didn't start the process till now, since there was no certainity about finishing. Now I am concerned about how to do this process. I realize there is backlog in i-130 processing. Can I start the i-130 process and give the Indian address in that form so that while she finishes her PhD, i-130 will be approved and she goes back to India for further processing? Is that allowed? Or should I give the German address and she stays in germany till the complete process is done? In case she can't stay beyond Dec 2013 in Germany, is it possible to move her processing to India after i-130 process was started/approved. Anyone with a similar situation?

You can do Direct Consular Filing through the office in Frankfurt.

I know it’s quicker than normal, but I know little about the process but there is a section for DCF here on VJ.

No he can't because he has indicated in his second post that he, the petitioner is not living in Germany.

But I, the petitioner, is in US. So DCF cannot be used, I guess?

September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

July 23, 2025:  Filed N-400 online

OP: I have seen where people have switched to a different Embassy/Consulate. I’ll see if I can’t find the threads for you. They may help you with the address decision.

I did find more threads googling but that seemed to have the most info in it. Some cases have gone quite quickly and others not so much lately with the transferring around of files - depending on where it’s being adjudicated. Because it seems simple enough to change it at the NVC stage, perhaps filing it where she is currently living and then making a decision as to which Consulate when it’s closer to Dec would be best. She will need legal status in Germany to be interviewed there and as you stated she can’t remain beyond then anyways.

She will need police certificates from the countries she’s lived in since 16, so if she goes back to India to live for a while make sure she gets her German one first.
