Hi,

My wife's 2 year GC expires October 26, 2013. As I understand it, we must submit the 751 about July 26th. Is this correct? We are not using an attorney so want to make sure we do everything OK. Will no doubt be reading more on this forum plus asking more questions.

Also, she has an art exhibition (she's an artist and will exhibit) in Rome, Italy that she can attend the last week of July if possible. Is it? She's now in China (been there for 6 months to take care of her parents) and will be coming back to America but we wanted to see if it was OK for her to attend the exhibition before she came back to the USA. She would get back into the states first part of August. Are there papers she needs to sign to send in the 751? I'm assuming biometrics will be in late August?

Any help would be appreciated! THANKS!!

She needs to sign the forms as do you. It is a joint petition.

You can send your I-751 form at ANY time during the 90 days, there is no requirement to send it on the first day of the 90 day period. Just submit the I-751 wait when she gets back to the states in august.

I guess the next question would be if she stayed away from USA until August, it would be more than 180 days. Will she get hassled coming in to the States?

This is one of those where the answer is depends. Depends on the CBP person and their mood. Depends on what evidence she has for maintaining US residency--i.e. your home, you are still in the US, went to take care of her parents etc. She might want to come back to the US before going to Italy. If citizenship is important to her than being outside the US for more than 180 days does have consquences. Long stays outside the US as a LPR need to be well planned with all the ramifications looked into. Always remember that only USC have to be admitted to the US.
