Quick background:

I'm citizen of US and currently living in states. My fiancé is citizen of Australia and is currently in his home country. We have had relationship for past 4 years. Both financially sound, no criminal backgrounds, and plenty of evidence of relationship. AND expecting twins in October (planned but didnt think would happen so quickly)!

So...

I have two choices and not sure which was is better so please posts yr thoughts.

Scenario 1

Start the process now (June), he plans to come over in October for the birth and stay about a month, then go home til process approved. I do have family to help out while he's gone.

Pros: hopefully visa will be approved by jan

Cons: when he comes to visit may be turned away and miss birth. He also could miss out on the babies for another couple months if process is delayed.

Scenario 2

He comes over for the birth on esta. While he's here, I start the process. He stays for a month, 2 at most and then returns home and awaits for approval. I'll be able to travel in jan to visit him.

Pros: he'll be at the birth

Cons: process could take awhile and miss out on a longer period time with the babies. Not sure if he can stay the full 3 months of his esta if we apply while he is here.

All thoughts or ideas are welcomed.

congrats with your upcoming twins...i'm also expecting twin boys (due on july 24..but might have them sooner) i'm 32wks and 2days today =)

my advice why wait..if i were u i will go ahead and file now...twins pregnancy don't last 40wks so you will probably have your babies around sep. twins pregnancy last up to 37wks..but usually they come early between 28wks-37wks (premie babies)

anyhow take it easy twins pregnancy are too delicate...so try not to stress yourself.

Mid oct is 36 weeks but your right, sept may be the month.

My initial thought was why wait, I'm just worried he would be turned away when he comes for the birth. He doesn't plan to visit befor then which I thought would be wise.

Congrats on your twins as well. I have two already and I wanted one more... I guess god had other plans!?

I would also file now for the same reason as mentioned above, so he can be with you full time asap, and if he can, have him stay the three months possible on ESTA when he gets here for the birth/ soon after. I know you say you have help from family but I also had twins (they are 5 now! ), and you will definitely need ALL the help you can get. PLus, do you really want to visit him with 4-ish months old twins? That would be a very stressful trip...

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

oh wow i guess we both get some advice with penguin_ie she's ahead of us for having twins lol me too i have a boy his about 13yrs old. my husband even i'm still pregnant his already planning to have a baby girl lol

don't worry you might get luckier that your K1 application get faster approval. like the saying twins are lucky charm dancin5hr.gifdancin5hr.gifdancin5hr.gif

Thanks for your comments. I'm going to start the process now. Already have everything ready (very organized).

Lets hope the twins come in October. I have 2 boys (8 and 14) he has a 14yr old boy and we found out we are having a boy and girl. I'm done after this! Not a vehicle to hold any more.

Hi,

Congrats on your up coming birth of the twins. If you are still going through the immigration process when the babies are born make sure you register them as "Children born abroad" to a US citizen.

Then you only have to worry about them immigration of your other children. Then it is two less immigration paper works you have to worry about.

As long as his passport is stamped for the full 90 days allowed under the VWP, he will be able to stay for the full 90 days whether you submit your petition for the K1 or not whilst he is here.

I travelled to the US on 18 July 2012, submitted our K1 petition on 20 July 2012 and stayed until 15 Oct 2012 (89 days).

However, I agree with other posters - file now, if you have all the necessary paperwork. I continued to travel after submitting our petition (I'm the beneficiary).

I think you missread- it's the US citizen, living in the USA, that is pregnant.
