Hi Guys,

I'm the US Citizen and I want to bring 2 brothers to the US. They are over 21 and sure that one of them will marry in next 3 or4 years.

I'm submitting the document to bring my mom here too. If everything goes through, me might be here on next year.

I have a question for the case of my borthers: Will I submit the document to pertition them or waiting for my mom? Because if they marry, my mom need to have the citizenship to pertition them.

Can I submit the document (F5) now and when my mom here, she submit another document (F2B) to pertiton them? Because if they still single, they belongs to F2B and if they marry, they belongs to F5.

Please give me an advices. Thank you in advanced.

As a US citizen, you file for your brothers in the F4 category. Wives and children under age 21 are included.

As an LPR, your mom can file additional petitions for her unmarried sons. If they get marry when mom is an LPR, then the petitions she files automatically are voided as an LPR can never have a petition for a married child. If they get marry AFTER she becomes a US citizen, then they move to the F3 category.

They can have two petitions at the same time, no problem. You can petition now and when Mom obtains her citizenship she can also petition. They are two seperate processes but the bonus to it is if, God Forbid, something happens to one petitioner, the other petition is still there.
