OMG...case frozen since January, another RFE.

Paystubs?

My husband drives a taxi and receives 1099 form, similar to a waitress job, he goes home with cash and tips nightly, therefore, he does not receive a paycheck per se.

Your employment letter seems fine.

Bank statements aren't necessary, especially since he doesn't actually qualify to be the sponsor. (you would only do that if you were using assets to make up a shortfall).

Thank you all very much for your help. We have just obtained a proof of employment letter for my husband to support his I-864. It's hard to believe that after 5 months with legal representation, we are just doing it now.

Just to be safe, we also have a bank letter, and 6 months of bank statements, as per our lawyer's request. The lawyer is tentatively coming on Tuesday with the I-864 Affidavit of Support for petitioner for my husband to sign.

He also should have with him at that time a letter acknowledging that the USCIS is recognizing him as our legal representative so that he is able to obtain information, and to legally act on our behalf.

Believe it or not, our lawyer failed to establish himself so far with the USCIS as our legal representative. He claims, that he supposedly did that already, but according to them, he hasn't done so.

As far as our lawyer can tell, we have 2 case files, one in my husband's name, and one in mine. Our lawyer has been informed that my husband is under investigation for an old misdemeanor charge. He isn't worried because he says it is just a routine check, but should we worry?

I don't think this has been mentioned yet - include a printout of your approved ESTA application, along with the photocopy of the passport page with the entry stamp.

Hi Harpa, in fact we turned in my husband's federal tax returns for 2011 when we initially filled our case on January the 2nd with the USCIS. Right now, in the 3rd and latest RFE, they are once again asking for his latest tax returns so, we are going to send both his 2011 and his 2012 tax returns in next week as he filed taxes in April and they are asking for the latest tax return. Thanks to our lawyer this is the part and parcel of what we are dealing with at the moment with all the delays.

I think you're on the right track Tina. What have you done to figure out what was going on with the marriage cert? That's the only thing we haven't covered here. Are you sure it's the right one? (not your marriage license, not the unofficial one, etc)

Thank you Harpa. We went to the local town hall where we got married, and got (yet another) copy of our Marriage Certificate, so yes, we are posting it with everything else. It is the proper one, with the seal and all, not marriage licence.

Hello All, I just found this sample (see below) of how to reply to REF, and have a question. What exactly should we put where it says : RFE letter (number, date)...? What number? Is it our case number or should we just put on I-485 ....? Maybe perhaps someone could give us a link to a sample letter which is easy to follow..? Many thanks.
