My fiance's 2 girls are US born citizens, they live in Mexico with her. Normaly one if not both of the girls come to stay with thier grand parents for summer vacation. We are talking about bringing them both here this summer, and letting them stay until after the interview, which we hope will be no later than this fall. If they are in mexico when she goes for the interview it will be hard for her to find someone to stay with them in Mexico city so she can be gone for a week for the interview. Also we would like them to start school here this fall.

My fiance is concerned that the CO will think that she is only wanting the visa so she can be with them in the US. She is worried that will cause her to be denied. I think that since they were with her before we filed and only came to the US before the interview, that no questions would be asked. It seems to me that the CO will know that the girls were not needed at the interview and would not be concerned that they are in the US visiting family (and me). I will be in Mexico for interview but doubt I will be allowed in, then travel home and wait with the girls for their mom and my wife to be.

I personally do not think it will be an issue. They are US citizens that have lived in Mexico with her all this time and have already traveled back and forth to the US. The CO will not even know the children are in the US at the time of her interview unless they directly ask her where they are at the moment. If you have evidence that shows you are a real bona fide couple, then I don't think they would deny her because her children are US citizens. I think it might be more of an issue if the grandparents had custody and the kids were living in the US. That would give her a reason to want to move to the US to be with her kids. That is not the case though. She already has been/is with her children.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
