Recap:

The 1st K-1 was denied and then he filed a I290B appeal. Until now, no news but he has until next month to know the answer if the appeal approve or denied. Let say it's a denial and in June 2013, he resubmit the 2nd K-1 all over again.

Question in K-1:

Part A: Information about you

Q11: Have you ever filed for this or any other alien fiance(e) or husband/wife before? If "Yes", give name of all aliens, place and date of filing.

What is the answer here? If yes, does he need to explain why? Or the answer is No?

VSC K1 & N400 Timeline:

1/05/2009 Sent I-129F, G-325A + other documents as required. $455 fee
1/09/2009 NOA1 Petitioner received
4/30/2009 NOA2 Petitioner received (approved in 105 days from NOA1 3.5months)
6/08/2009 Packet 3 Petitioner received
6/20/2009 Packet 4 Petitioner received, mail everything from above forms & I-134 plus other doc as required for beneficiary
7/23/2009 Interview @ 7am, Interview passed- visa pick up July 31st

9/15/2009 Applied for Marriage License $40
9/29/2009 Applied SSN (bring SS-5, Passport, & I-94). Went to local County District Court for Marriage License $38.50 fee... Officially Marriage. Received SS card in less then 2 weeks. 2 weeks later, apply for State Photo ID

Why were you denied?

This is for a friend. I do not know the whole story but all i knew was he's missing a lot of doc. He said he never receive RFE instead he got I290B to appeal the denial. so he appealed and paid the fee. Until now, no news from the appeal. Nest month is the 90days deadline to know the answer.

@Inky: So that mean he needs to explain y his first K-1 denied, and does he needs to put the old case number from previous K-1?

It is very important to know why he was denied. If it's because he missed a lot of documents, the appeal WILL BE DENIED. The appeal is to review the decision based on what was submitted. What was submitted was insufficient, therefore the decision stands. Tell your friend to simply re-submit the K-1 with ALL REQUIRED DOCUMENTATION. Yes, Inky is correct.

If it asks for the case number yes. He should fill in all the details requested.
