Hi,

Once again...I'm confused.

For the I-864 Affidavit of Support, does my US spouse need to already have a job offer in the US? We are filing from Canada (not DCF though).

No, but you need to establish domicile, which means to provide evidence that you intend to settle in the US. Mail or e-mail negotiation for a home or apartment, registering the kids in school, yes a job offer if you have one, other things that indicate strong ties to the new home in the US.

The US spouse must have enough qualifying US income or assets, but they need not be from a job, and should not be your intended primary residence. Lacking this, you can get a joint sponsor who is a US citizen or permanent resident. Search the forum for more information on joint sponsors.

I'm a dual US/Hungarian citizen (both by birth; Hungarian citizenship verification TBA), and my husband is a dual British/Irish citizen (by treaty) from Northern Ireland. We are atheists.

08 Jul 2013: SSN received (at SSA office)

07 Aug 2013: Green Card received

27 Feb 2014: Whoa, life happened. Planning move "back home" together to Republic of Ireland by end of April.

29 Apr 2014: POE Dublin through Heathrow

15 May 2014: Received formal residency/work permission (GNIB card with Stamp 4, one year renewable) for the ROI

Thank you- that helps clarify things.

We have a residence set up already. But we have been living and working in Canada for 3 years now, so no US income or assets. So a joint sponsor might have to be the way we go. I will research further.

September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
