after getting married with the k1 visa in the U.S do i have to file the AOS application before the 90days are over or can i wait on it even if it passed the 90days period?

No all you have to do is get married before the 90 days. You can file the AOS paperwork after the 90 days.

You have to get married within 90 days. You do not have to submit the AOS paperwork within 90 days, but I advise you to do it as soon as possible, so you can start working and, if necessary, travel abroad. In many states you will also need your EAD to get your driver's license/learner's permit. I can tell you one thing, it can get pretty boring if you have nothing to do and you are stuck at home all day. :wacko:

I live in Las Vegas Nevada. I got a social security card for my wife within 2 weeks of her arrival but I neglected to get a Nevada State ID for her and didn't apply for one during the 90 days in which the I-94 was still good. I went to the DMV 6 days later and was told that because the I-94 was expired my wife was not eligible for a state ID. Where ever we go she has to show her passport which is somewhat of a hindrance. We don't fly anywhere because of her expired I-94. I suggest you take your wife to get a State ID before the 90 days are up since you will be waiting a bit to send in your AOS.

You can fly anywhere in USA with just the passport as identification. She is still legal, just out-of-status because of the expired I-94.

Even if you were able to get state ID or driver's license. The validity of those will still be dependent on the date of the I-94.
