I am the petitioner helping my wife get her immigration visa. Her interview at the Guangzhou embassy is in about 2 weeks and I am having trouble understanding the marital status certificate requirement.

We are married and have our red marriage book (结婚证). In the immigrant visa instructions it asks for the following:

□ MARITAL STATUS CERTIFICATES:

Married applicants are required to present a certified copy of their marriage certificate. Applicants who have married in the People’s Republic of China must have a marriage certificate issued by a local notary public office. Certificates showing the termination of any marriages are also required (e.g. death certificate of spouse, final decree of divorce or annulment).

So my questions are:

1. Do I just get the marriage book translated into English or is the marriage status certificate something else?

2. If I need something else, can we get it in the city we are in (Shenzhen) or do we need to go to where her hukou is (Hubei)? "local notary public office" is unclear to me.

3. If we need to go where her hukou is, do we have to go in person or can we have a family member who lives in Hubei do this for us and just give them whatever they need to do it?

Thanks in advance for the help.

To get the semantics out of the way first, her interview is at the US Consulate in Guangzhou; the US Embassy itself is in Beijing (and as you already know, immigrant visa interviews are not conducted there).

Answers:

1. The translation of your red book marriage certificate must be done by the notary office where her hukou is located.

2. See previous answer, you will need to go to Hubei.

3. A family member on the household registration can go to the notary office on her behalf.
