Hello... I am living in Cabo San Lucas with my husband, we are recently married. I am American and we would like to start the visa filing process to move back to Chicago. I am working here with an FM3 visa. Which is the best route to go, filing for a spousal visa or a direct consular visa? My husband filed for a tourist visa in 2010 and was denied. Other than that, we have no other experiences. Any suggestions?

Mary, the way to go is the IR/CR category. The process is lengthy but well worth it. I am not sure if/where DCF is possible in Mexico however.

However, you might want to find out HOW USCIS office handles the intake on the I-130 (walk in vs mail in)

It is recommend to file in person in Juarez, but Mexico City accepts mail in applications. Where you file depends on who has jurisdiction over the area of Mexico you live. DCF is available in Mexico. According to the info you have provided, you qualify for DCF.
