But gender is completely different. It's quite simple to create a consistent, objective, non-recursive definition of gender.

In the context of incest, which is the subject of this topic, gender is immaterial.

quite simple, boy or girl. chromosomes tag it. there is no room for abnormality. hormones have no baring. people must be classified either/or.

my point? it isn't "quite simple" to define.

It's not difficult to determine what chromosomes a person has. Those with a Y chromosome are male. Those without one are female. That's fairly simple to me.

Obviously you can try to complicate it if you want to. Sort of like if I ask you how tall you are. It's a simple question that has a simple answer. If you want, you can go on about the shoes you're wearing, the time of day, how tall you used to be, how tall your relatives are, what you think the ideal height is, what you think the average height is, how you might become a paraplegic at some point, what your birth weight and length were, etc. You can add extraneous detail to anything. But it's still a simple question.

That is how it is currently done, except in the cases where the genetic markers are not clear.
