I would like to know if there is anyone in the same situation as I am in. My partner is an American Citizen living in Pittsburgh PA, and I live in St. Catharines, Canada. We were legally married in Canada on Dec 17, 2005. I would like to know if the process of application is the same as the K-3 Spouse Visa??? Your imput would be greatly appreciated! Cheers.....

Unfortunately, as the US doesn't currently acknowledge same-sex marriage, I don't believe that you have any recourse to move to the US on a family-based visa.

Moving your partner/mate to Canada may be a different story...if that would work for your situation.

You can sponsor your spouse to immigrate to Canada, but your spouse cannot sponsor you to immigrate to the US.

If you have a university degree and a job in the US with a company who may be willing to sponsor you for a TN, that might work. But family based is out of the question. At least for this century.
