Some K1 questions

Timeline

Hello All :) I read the immigration discussions on VJ around 3-4 times a day and sometimes people confuse me! We already sent the I-129F package 4months ago and since I'm really precise, I was 100% sure that we didn't miss out anything. But when I saw other people's own checklists, I got confused. :help:

- I am the beneficiary, the foreign fiancée. I didn't have to send my birth certificate, did I?

- What about the petitioner's financial stuff (taxes, bank accounts, etc)? We didn't send anything like that either, I thought we needed it after the NOA2.

- And do you guys know anything about Vermont Service Center? I know it's quite "fast" now, it takes around 5-6 months until the NOA2, is that correct?

- I know it's different in each country but is it okay going to the interview without my fiancé being there?

- Which language do I have to use at the interview? Hungarian or English?

20th August 2016 - N-400 filed

26th August 2016 - NOA1

12th January 2017 - Biometrics (again)
30th May 2017 - Interview (approved)

No, just be prepared with it for your interview

- What about the petitioner's financial stuff (taxes, bank accounts, etc)? We didn't send anything like that either, I thought we needed it after the NOA2.

The petitioner will need to send you the completed I134 for your interview. Although this form only requires 1 year of taxes and a demonstration of meeting 100% of the poverty level for your household size, it would be best to include 3 years of tax information along with a demonstration of meeting the 125% of poverty guidelines as it seems that many embassies follow this for K1 and you will need to meet this for AOS anyway. You will need the petitioners bank statements if the income is not sufficient to meet the requirements and you are using assets to make up the difference.

- And do you guys know anything about Vermont Service Center? I know it's quite "fast" now, it takes around 5-6 months until the NOA2, is that correct?

Yes the VSC has recently really picked up the pace. I wouldn't put tooooo much stock in the 5 months, but as for now 6-7 seems totally reasonable. To get a better idea of where they are with processing, take a look at Igors list once in a while. Also it can be helpful to follow some timelines of people with similar situations to yourself to gauge how long things are taking.

Yes, your fiance is not required to attend the interview, and the decision for the petitioner to attend the interview is a personal one only you can make. I would urge, however, if there are any so called red flags about your case, it would be helpful to have the petitioner there for the interview as it can only strengthen the case of a bona fide relationship.

- Which language do I have to use at the interview? Hungarian or English?

You may take your interview in whichever language you would prefer.

Good luck!

We did not submit the information until my fiance had her interview, so don't worry about that, just make sure that you have it for your interview.

I did not attend my fiance's interview and she passed with no problems at all. I was only able to spend 1 week with her and she got approved.

We were with VSC and we got our NOA2 after 206 days, but it looks like they are moving faster. I would not expect to get approved in 5 months, although you may and I hope that you get approved quickly. You might be setting yourself up for disappointment if it takes you longer to get approved.
