i-864 plz help

I am preparing aos i864 , i have couple of questions hope u help me in them .

We r using a joint sponsor since we are filling from abroad , this joint sponsor is retired from couple of years but his income exceeds poverty lines . Shall i send the i864 , copy of his us passport and tax returns for the previous 3 years only ?

My husband the petitioner will fill form i 864 too but since we are abroad , he doesn't have tax returns for the previous years , what shall we send with his i864 ? and what shall he write in his income part ?

Also in Q#21 , shall he write 1 in the box beside married ?? although it was already counted in line 10 ( as the immigrant in line no 10 is me his wife ) .

You are correct on the co-sponsor.

Did your husband work? If so, he was supposed to have filed taxes with the IRS even if abroad. He will need to back-file for the last three years at least.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

For question 21 if you are already counted then NO he will not count you again under married/spouse. But if your joint sponsor is he would then count his wife, him, and you which is done automatically.

I am also preparing AOS i-864. We also are using a joint sponsor and filing from abroad. I'm currently living in Egypt with my husband (I am the petitioner). I didn't work for 2010 or 2011 and in 2012 I just worked for three months part time in a seasonal job. So I will put in the blank for income for 2010 and 2011-0 and then for 2012 I will put the little amount that I made. Also since I didn't have to file tax returns for 2010 and 2011 and I was exempt from filing for 2012 because my income was too low, I will attach a signed note from me saying this and the reason. I will also staple this note to a page of the IRS publication that shows proof that I am exempt from filing taxes. I attached that document here. It is in the part "Who Must File Taxes" in the 6th paragraph I am pretty sure. Just highlight the part that shows you don't have to file taxes if your income is too low or non-existent . :) I hope this helps!! I was stressing out about it too for so long and then realized it is so easy!

Hi Mady!! I was just looking at your timeline and your I-130 got approved so fast!!! :) Do you know any reason it took so short? I sent mine in in August and now its been more than 7 months of waiting!! But hopefully it will come soon! :) This is the link for the IRS publication. http://www.irs.gov/pub/irs-pdf/p501.pdf I don't think it showed up in the last thread! My internet is so slow today, I think in Egypt in general! :(

Anyways, even though my I-130 isn't approved yet, I'm just preparing for the next step already! I am just going to put for proof of domicile that I have a mailing address there, my bank account there, driving license, and maybe show classes I'm enrolled in at the college. That is really all I have. But for sure a job offer would be good proof and a copy of the U.S Credit card. Just anything that could show proof I would think! I'm not an expert on this topic though! The more the better of course! :)

I think it was approved fast as we sent our Egypt addresses ( both petitioner and beneficiary ) , we are both actually from Egypt plus we do have 2 kids ( Both acquired citizenship through their father (Born to a US citizen) , And maybe cuz we have been married for 3 years .. that's all what i can think of

What I send for proof for domicile are:

1. US bankstatement

2. Pre- register my son to school

3. A least agreement from my mom-in-law where we intent to live.

Ohh thanks alot , i really appreciate ur help . did u send proof of domicile as well ?? is job offer in the usa plus copy of driving licence sufficient ?? shall we send too a copy of us credit card for example ?

Mady, I saw you were asking about the proof of domicile! Here is the letter I prepared when I was getting things ready! I prepared it all! I hope it helps you! I also have many cover letters prepared! I will love to help u if you need help!

Marisa, I would not recommend leaving the income for 2010 and 2011 blank! Put zero as an answer because that could be an excuses for them to give you a checklist! They want to see everything complete. If you don't have income, put zero. It won't matter if it's zero or not cause you already have a co-sponsor! they just want to see that you filled everything in! :) Good luck!

They want to see everything complete. If you don't have income, put zero. It won't matter if it's zero or not cause you already have a co-sponsor! they just want to see that you filled everything in! :) Good luck!

I think that would be a good idea! As long as you state a reason and sign it, then attach it to the IRS publication :)

Yes! Go ahead and write ZERO for the three years! Include a letter along with you I-864 saying that your husband did not work from 2009 to 2012 because of family issues and therefore, his income is ZERO. Therefore, he is not expected to file taxes for those years because he did not meet the minimum income requirements to file. That should be enough :)
