Filling i-130 for my mother

Hello Everyone,

I'm about to file a petition to my mom and I want to double check my paperwork before I send them I have a complex situation.

My situation:

I'm 21 years old and filing a petition to my mom I'm a US Citizen by birth but I don't really know how to classify myself I'm born in the Philippines I acquire my citizenship from my father and I have a Consular Report of Birth Abroad (FS-240). My father passed away before he can file a petition for my mom I've been in the US for 5 years I'm living with my step brother so when my petition gets accepted my step brother will be the one to file the affidavit of support. so that's my situation. Some of that things that bothers me is my birth certificate (from NSO). My mom's name is misspelled in my birth certificate her legal name is Mariflor but in my birth certificate it's spelled Miraflor my relatives suggest that she just need to have an affidavit made from the notary public so i got that covered and I'm hoping that USCIS acknowledge it.

I apologize for reading this long but I really need help. Am I missing anything? if so please let me know

Some of that things that bothers me is my birth certificate (from NSO). I was also in the same situation with you on Birth Certificate issue, I got an RFE because of the clerical error in my BC. In the RFE letter, it was stated that USCIS does NOT accept an affidavit. Did your mom file a petition to correct the clerical error at NSO? My dad did it 5 years ago, then they issued a "Certificate of Finality" or Petition to correct clerical error. That was the official document I sent to USCIS and got the approval after a week.

I'm not sure but you could be asked to do a DNA test. What I've seen happen a few times are people who have corrected names on birth certificates being asked to do a DNA test just to make sure these persons aren't trying to be fraudulent by petitioning for someone they are not related to by blood or marriage.

There were several mistakes in my BC but in my case, they never asked for DNA test. I just sent the Certificate of Finality from (NSO-Philippines). Maybe it also depends..

oh okay that make sense but I will take a shot anyway and if they wont accept it I will have her petition to NSO and get a Certificate of Finality

quick question did he file it at NSO on where you were born or it doesn't matter?

He filed it at NSO where I was born. But I think it doesn't matter which NSO location.

you're welcome smile.gif I did not provide the Form G-1145, I think that is optional. I just registered at uscis.gov to receive email/texts notifications about the case.

I already got Noa2 from USCIS they are forward it to NVC. I think have same situation here. My father's name in my BC is Tiatre and in their marriage certificate the same also in my marriage certificate.

Most of his papers is using Tiatre but the NSO copy is Ramon Tiatre also in his passport.

How long it took for your father to get the certificate of finality from NSO? Did NSO officially change his name or just a paper stating that this 2 name are the same person?

I never get rfe from USCIS but I might in NVS, which I hope not. Just want to be prepared. Thanks for this post ..

In addition maybe I never got the rfe from uscis because I didn't submitted my father nso copy only their marriage certificate and my birth certificate where his name is the same.

What are the documents that NVC needed from us and how much you pay for both parents ?

In my case before, Mine and my father's last name in BC doesn't match because of the clerical error.(ex.: Garcia was spelled as Gancia) that was the reason I got an RFEbecause they wanted a proof that both names are same person. In 2005, my dad filed a petition to correct the errors at NSO, the whole process took 3 months. I'm not sure thoughif the timeframe is the same might be shorter these days coz of Aquino's law about the clerical errors in BC. And yes, NSO issued a Certficate of Finality. It is an official document stating that my dad filed a petition to correct errors in my BC. Also they put an annotation in the bottom of my BC the corrections stating that Gancia has been corrected to Garcia. Maybe you did not get an RFE because they havn't noticed a clerical error on your dad's BC and yours.

What do you mean you did not submit? was that your father's BC? It is not actually a requirement to submit your parents BC in the USCIS stage. You will have to do it at NVC though.. should be original/ certified civil docs of your parents and yours.

list of civil documents:1)original birth certificate-NSO issued for each of my parents. 2)original marriage certificate-NSO issued (2 originals). 3)copy of passport biographic page - that has name, dob & place of birth for each of my parents. 4)two passport photos - 2x2 colored for each of my parents. 5)original police clearance/certificate. 6)NBI clearance

as for the payment, you will have to wait for your case number to become available(20 days) and Pay the AOS fee of $88 for both, and $230 IV fee for each of them.
