Hi everybody,

This is my first post. I have seen the wonderful advise you give here, so I thought I might try to ged some tips from you, too. I have been in the US for a little over two years on my student visa (F-1), which expires Aug 07. I finished my degree and went on to one year of optional practical training. In September I married my USC fiance, and AOS packett was received in Chicago on Oct 30. I have applied for AP, but I realize that it is highly unlikely that I will get it before Christmas. I still want to go home for Christmas, even if that means not being able to return right away and starting AOS over again whenever I make it back. There is no emergency at home, I just feel a strong need to spend Christmas with my grandparents who are old and frail. Call it a moral obligation, if you like. I don't think it will get me an Emergency AP, though. So my question is: What do I do when I get back to my country in order to return to the US. Do I apply for a k-3 visa from home, or do I do what is referred to as a Direct Consular filing? Thanks for any advice you might have for me!

Norway does not allow DCF unless the USC is a resident of Norway.

You would need to follow the CR1/IR1 route and optionally the K-3. Are you willing to spend a significant amount of time in Norway following your Christmas visit? It could take many months.

Dear John and Marlene,

Thanks for the information, which was very helpful and clarifying to me. I realize that I would have to spend several months at home in Norway if I go without advance parole. I don't know what to do, but right know it feels impossible not to go, as that would mean disappointing my old, ailing grandparents who practically raised me. Not knowing that it could cause me immigration problems, they have practically begged me to come. What a dilemma! Anyway, I guess I am curious if anyone out there received their AP in less than 60 days. I am hoping for a miracle!

To me, a year is many months ... so is 2 years ... so is 6 months.

If you explained your dilema, do you not think they would be happy to see you a month or so after Christmas? Surely they would not want you to jeapordize your residence. A month or so delay in your visit will miss Christmas, but you'll still be able to see them soon and not lose your status.

I am sure if your are truthfull with your Granparents and explain to then what will happen to you if you leave here without the correct paperwork you will not be allowed to reenter for many many months, I am sure they will understand... they may not like it but they will understand... reasure them that as soon as you have the paperwork that will allow you to travel, you will come to visit...

dont mess up your application because you are feeling a bit guilty....
