Hi there,

Thank you for looking at my post...

I need help.

Husband and I met online and have been in a relationship since Jan 2011.

He came to me in December 2012, and we got married on the 26th of January 2013.

He is in Australia at the moment. Not sure how to go about doing this...

- What are the forms I need to fill in apart from the I-30 and G-325A?

- When do I give a police report?

- Just a photocopy of all documents are needed? Do copies need to be signed by a justice of peace?

- Do we need to fill in an affidavit of support form?

- What form do third parties have to fill in to swear our relationship is legit?

- Does the check have to be from a US bank?

- Is the interview done with both me and my husband present?

- when do I do the medical check?

I just want to make sure I do not miss anything.

Hi! Welcome to VJ. There are guides at the top of the forum, that will show you what to send in and when to send it.

Your husband will send in the I-130 to USCIS. The guides say what forms need to be sent in at that time.

The legal documents you send in (marriage license, long form birth certificiate, etc) need to be originals or certified copies.

Most police reports are good for a year. Check with your country. The police report is filed after the I-130 has been approved and sent to the service center (depending on what part of the US your husband lives in.)

There are samples of affidavits under the example forms listed at the top of this forum.

Yes, the sponsor fills out the affidavit of support, but that is for the NVC stage, if I remember right.

Yes the check/online payment (depending on what country you are petitioning from) has to be from a US based bank.

Depending on the country, your spouse might or might not need to be with you. Canada? No, not necessary. Ecuador? You will not be approved unless your spouse is there. You might want to check the subforums for the area you are from, for specific info.

You will take your medical after you get your interview appointment. Make sure you leave enough time before the interview to get the results back (once again, depending on your country).

Someone else will come in and fill in the spots I missed.

Please fill in your timeline - once you get started! Good luck, and have patience. This process takes time and a lot of patience.

- When do I give a police report? Second stage

- Just a photocopy of all documents are needed? Do copies need to be signed by a justice of peace? Photocopies for I-130 stage. No notaries.

- Do we need to fill in an affidavit of support form? Eventually yes, please refer to guides.

- What form do third parties have to fill in to swear our relationship is legit? It's not a form. It's a letter, and it also isn't required.

- Does the check have to be from a US bank? yes

- Is the interview done with both me and my husband present? The interview is for your foreign beneficiary. It's your choice if you choose to be present.

- when do I do the medical check? I think you said your husband was the alien so YOU don't. Your husband will after he gets his interview date.

I just want to make sure I do not miss anything.

I am the beneficiary - my petitioner is here in Australia at the moment, and will be going back in a month's time to petition for me.

I have read the guide - but no matter how much I read I always miss things :(:bonk:

Ok well my responses were mostly for if your husband was beneficiary, hopefully you can interpret them knowing that.

It is best that the USC take charge of the I-130 petition and coordinating things. :thumbs: Even for another fluent English speaker, interpreting the American bureaucratic nonsense is best left for an American to wade through.

LOL thanks but for some reason my American husband is not all that savvy with ANY bureaucratic nonsense. Hence I am taking charge :wacko:

My husband cares about Transformers and Iron Man.

He asks me to fill out EVERYTHING for him.

Go to the doctor? Family history in MY hands asking him questions.

LOL well all my husband cares about is the computer. I do all the filling out of everything. He can't even buy himself a bus ticket :wacko:

Sometimes the beneficiary has better understanding of the bureaucratic language than the USC, so it really cannot be generalized...
