I filed my taxes already, so I am thinking there is nothing else I can do, but I still have this doubt in my head. I always go with the same lady and she was also helping me with the immigration process. She knew I got married last year on dec 22. However, she said that I had to file SINGLE because my husband is not in the USA. He is in Mexico and he does not have a SSN. She also said that the IRS was stricter this year with people applying for ITINs. I agreed to her filing this way for me and now I am having second thoughts. I was reading another post and was a little confused. I need to know if she was correct or not. I am scared that I made a mistake to filling this way and now it will affect our application proccess. Can anyone please tell me if this was done correctly or not.

05/17/2013: Priority Date, case transferred to National Benefits Center (NBC)

05/22/2013: Received Official Receipt Form (Form I-797C), Check for $420 cleared bank account

12/12/2013: Petition transferred to Nebraska Service Center for further processing

02/14/2014: I-130 Petition was approved

02/25/2014: NVC received case

04/02/2014: NVC assigned case number

04/02/2014: Completed DS-261 online

04/02/2014: Paid NVC AOS Processing Fee Bill Invoice

05/20/2014: NVC received AOS Package

06/12/2014: Paid NVC IV Processing Fee Bill Invoice

07/18/2014: AOS Package approved

08/12/2014: Sent IV Package

08/15/2014: Received letter from NVC confirming IV Package was received and to wait 60 days

11/03/2014: Interview date scheduled

When I was married in 2011 I was told to file those taxes as married, filing separately, which we did. This does not require a SSN or ITIN and is designed for spouses living abroad.

He did still have to sign it though. All went well, I got my tax refund with no issues - he was here for 2012 taxes so all was good.

My husband was not here to sign either. I sent him the filled out forms, he signed it and sent it back. No problem.

No, if you file separately, your spouse does not sign.

As you were married, you are not allowed to file as single. Period. If you did so, you did your taxes wrong. When you are married, you may only file as Married Filing Separately or Married Filing Jointly (or under some rare conditions, Head of Household).

You'll need to amend your taxes. You need to file as married if you are married.

Are accountants and tax filers liable for giving and filing wrong information? I know it costs money to amend the form and in Canada if my tax preparation is done wrong, the person who filed it for me needs to pay the costs of getting it fixed. Does it work that way in the USA?
