Hi

I am new here and have one question ( at least for now) regarding the form I-485.

My student visa expired about a month before our marriage.

On the form I-485, they ask you the current USCIS status, and

I am not very sure what to write since it would be not true if I wrote I was F1 (since my F1 visa expired already)

Should I write "expired F1?" or N/A?

Also, would it affect me badly that my student status had been terminated before we got married?

"F-1, Expired".

Provided removal proceedings have not been initiated against you (you would have received either a visit from ICE or a Notice To Appear in the mail if this were the case) then you are free to file for AoS.

you can still write "F1" if you are still going to school. Visas expire but status doesnt if still going to school. In applying for AOS through a USC, getting married after the visa expires doesnt affect you.

Agreeing with the above post. The "visa" expiring is unrelated to your "status" expiring. The visa is only for entering the country. Once in the country, it's the I-94 that grants valid stay. But for F-1, the I-94 will say "D/S" (duration of status) for duration of stay. So it's the I-20 that tells you how long the status is (plus a 60 day grace period at the end), assuming you didn't violate your F1 requirements. If you left your school, then that may have terminated your F1 status.

There have been some posts on here lately of people who were no longer going to school and/or their F-1 visas expired. These people were asked to come in a talk to ICE. I remember one saying that ICE showed up at her front door. Make sure if you're out of status to file your AOS paperwork asap! It's okay to get married when you're out of status and file for AOS when it's to a USC. However, you will run into problems if you're put into removal proceedings.

There have been some posts on here lately of people who were no longer going to school and/or their F-1 visas expired. These people were asked to come in a talk to ICE. I remember one saying that ICE showed up at her front door. Make sure if you're out of status to file your AOS paperwork asap! It's okay to get married when you're out of status and file for AOS when it's to a USC. However, you will run into problems if you're put into removal proceedings.
