Hello everyone!

My name is Marine. I am from Armenia. I will appreciate a lot if anyone answers my question concerning K 2 visa for my son. I am in USA through K 1 visa. We got married with my US husband Nov. 2012 and my case is in process, as I was notified. My son is 18 years old (n 2 months he will be 19) and he is now in Armenia. I did not apply for K 2 visa for him by two reasons: I was said I had 1 year to apply for K 2 visa for him and I thought I would have enough time to find job and settle up here. And second, his biological father, my ex-husband, has been here for 5 years (he won Green card). He applied for his son on May, 2012 to immigrate to USA. Since he is green card holder, his case seems being frozen on "initial review" status for almost 10 months. I talked to my ex-husband and he said, he would apply for citizenship at the end of February and expected to become citizen up to May. Under such circumstances our son's case will speed up. He advised me not to worry and wait till May. But I am still hesitated whether apply for K 2 visa to proceed (my K 1 visa will expire on September) or to wait. So, my question is what way is faster and advantageous for my son? I am anxious because next year my son will be called to military service for 2 years and after it he will be over 21 and will not be considered as a minor. Please, if someone has information how does it take to obtain K 2 visa and how to do it, write, please. I will anticipate any response.

It actually might be quicker and easier if your son's father does it. Once he is a citizen, because your son is under 21 he would be an Immidiate relative, thus should get everything within a year. So if his dad is a citizen in May, your son might get his papers by New Year once his case is upgraded .... K 2 I am not sure about maybe someone else can comment on that. Good luck!

It actually might be quicker and easier if your son's father does it. Once he is a citizen, because your son is under 21 he would be an Immidiate relative, thus should get everything within a year. So if his dad is a citizen in May, your son might get his papers by New Year once his case is upgraded .... K 2 I am not sure about maybe someone else can comment on that. Good luck!

You are very welcome, once his dad upgrades your son's case and his I-130 is upgraded and approved (here are the processing times https://egov.uscis.gov/cris/processingTimesDisplay.do;jsessionid=bac6UlsoGP3h0gf1hL5Zt) NVC and Consulate should take about 6 months after that. Because you said that he applied in May 2012, it is outside of the processing time, so once it is upgraded to Immediate relative category, it will most likely be approved shortly after. And after that should not take too long to get your son here. The other benefit is that he will get a green card and will not have to go through AoS that I think you do with K2. but again, I have not dealt with K2 so I do not know the processrose.gifrose.gifrose.gifrose.gifGood Luck!

When was your K-1 visa issued? You haven't filled in your timeline so it's hard from your write up to determine that. But if you are still within the one year window of your K-1, then you simply email the Embassy and schedule him for his K-2 interview (he will also have to have a medical done).

Yes, second plan could be to have your ex apply for him as his son once the ex gets naturalization.

You can do it MUCH faster with a K-2. Simply call the consulate and make an appointment for him, he uses the same petition and case number you had. Make an appointment and apply for the visa. Email the consulate for their specific directions, they vary somewhat by consulate. We did both a K-2 with Alla for one of our sons and a K-2 to follow 10 months later for the other so he could finish his school year.

Tge K-2 MUST be issued within 1 year of your visa.

It is not quicker for the father. She can have a K-2 issued in a matter of a few weeks, tops. Whatever the lead time is for the interview. She can call and make an appointment for the interview today. Use the same NVC case number as for her K-1 visa.

I did not want to give misleading info blush.gif I am glad you were able to give a better and much happier news :) I guess if the K1 is still within the time frame, than the son can be here very very soon :)good.gif

Thank you. Yes, provided it is within one year of the issuance of her visa. I am not sure which consulate Armenia uses, perhaps Georgia's in Tsilbi? I would defer to you on that...but whatever their lead time is for an interview is how long it would take to get him here.

Because of his age though, he will not have a fast track to citizenship. If he were under 18 when his father becomes a citizen (as our Pasha was) then he would become a citizen automatically at the same time. Since he is over 18 and not married to a US citizen he will have to follow the 5 year path as our son Sergey has to, even though Alla is now a citizen.

Still, not a bad deal.

I am very grateful to you for all responses. As I see, I can call to our embassy in Armenia and give them my case number to schedule interview for my son. Is it enough (simply to call) or I should fill application or something else?

I received my K 1 visa on September 11, 2012. On October 14, 2012 I entered USA, and I had 90 days to got married and apply for adjustment of status. So now I received work authorization and social security number. It is only 4th month I am here. If it's faster to proceed K 2 visa, it will be great, because time is very important. Next year my son will be called to military service for 2 years so I am afraid this can create additional obstacles to him to immigrate. If he can stay here while his case proceeds, it will be great.
