Okay i just attached a picture of my paystub..

now i get paid biweekly so if you look close

i get $915.39 for my regular 12.70 an hour wage

and on "slot tokes" i get another $873

So total for the two weeks i get $1890 .. NOw my question is.. the "slot tokes" part is the tip i get which the department shares and pools so its like an extra $10 an hour for tips plus my $12.75 an hour wage...

now my tips or tokes gets directly put onto my check and they take taxes from it.. now my quesiton is is the uscis only gonna accept my 12.70$ an hour wage.. cause the tips are always diffrent.. even though it does stay around 10$ an hour somtimes even at 12$ hour no lower than 9$ an hour... and its been constant and my w2 shows i make like $48k last year.. will they concider what you made at the end of the year or.. will they not accept the tokes and only concider my 12.70$ an hour wage.. when concidering the support affi.

They will consider what your tax forms show as your adjusted gross income minus any tax liens you may owe to the IRS.

i dont owe anything to irs or have any liens.. So they will concider the tips i make?

They will consider what is on the line for Adjusted Gross Income on your tax forms.

Yes, your tips are part of your income, and clearly documented.

This is incorrect. Tax forms show past income and that information goes in an entirely different section of the affidavit. Pay stubs are used to document "current income". The current income is the total for two weeks times 26. Since it all goes on the paycheck and the W2 later, it all counts.

Facts are cheap...knowing how to use them is precious...

You're good with or without the tokes or tips. 12.70 an hour full-time can support a family of 4. If it is just your fiancee you are petitioning and supporting then you are okay. Claim everything including your tokes / tips. A lot of filers work commission based jobs and get approved.

Ok, I thought the OP was asking about what you put on the actual form.

The affidavit of support asks for four separate income figures. One for each of three prior years tax returns and one for current income. Pay stubs are used to document current income. Tax returns provide information about past income. One "qualifies" based on "current income".

Facts are cheap...knowing how to use them is precious...
