Getting stuff together for the I-751.

Our daughter together (born in the US, has SSN, has US passport, etc) obviously gets listed. But the USC spouse has a daughter from a previous relationship (born in the US, has SSN, has US passport, etc) who lives with her other parent and step-parent outside the US part of the year, and with us in the US part of the year. She shows up on our tax returns.

Do we list her, or do we only list "the child of our marriage?"

Also, just a month or two back, the non-USC decided to drop off some joint credit cards and accounts, wanting to work on having their own credit rating etc. Spectacularly bad timing, perhaps! But we still have joint car title and insurance, beneficiary stuff on insurance and investments, etc. And utility bills, trip receipts, photos, and oh yeah, a baby. No joint house yet, since USC has partial ownership of one from before. Will get that sorted out when we can afford.

Hoping that will all be enough!

I looked at the guidelines and other thread and I have come to the opinion that Part 5 needs information of all your children. Hope others with similar case responds.

11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

After seeing some other threads, I see that it also makes sense to just include just the children that need GC to be included here. Please call USCIS and seek their advise and also let us all know, so that others could be guided in future.

(Tell me again, what do we pay you people for? ;) She suggested listing all kids, noting that they are citizens and providing supporting evidence for that.

Called USCIS. Talked to agent G649221, who didn't have the I-751 in front of her, and said she couldn't answer questions about how to fill in the form. (Tell me again, what do we pay you people for? ;) She suggested listing all kids, noting that they are citizens and providing supporting evidence for that.

I found the answer - you need to include only those children that need their condition removed along with the parent in Part 5. If the child entered after 90 days of the parent, that child also can't be entered here. It makes sense why USCIS had asked for additional bio-metric fee when a US born child was added in Part 5 by mistake.

Please refer to I-751 instruction under "Who May File Form I-751?" and you will find the answer loud and clear.
