Hey! I am getting ready to send my I-129F petition to the US. My fiance and I are living in Lesotho in southern Africa. He has a child from a previous relationship who was born in the United States. The mother of his child is also a USC. I am wondering if I should include his son on the form in Part B question 13 where it asks to list all children of the alien fiance. I assume this is normally used for obtaining K-2 visas for the children. My question is do you think I should list his child even if he will not be getting a visa for him as he is already a USC?

I'm worried that if I include his son's name it will cause confusion/delay in processing the petition. I'm also worried that if I don't include his name it might seem dishonest. Any suggestions would be greatly appreciated!

Yes, you list the children even if they are not applying for the visa. There is a separate box that you tick if you are applying for them. But you MUST list them regardless.

Great! Thanks. I just didn't want to add any confusion or complication to the process. I don't, however, see a tick box to indicate if the child will be needing a K-2 visa. I would hope that seeing the US birth would be sufficient, but I don't know. Do you think I should add a letter explaining the situation or just leave it as is? Thanks again!

I don't believe an explanation is required. Many people have children that they do not bring to the US on a K-2 visa anyway but that are listed on the I-129F forms.

I think once you have an approval for the I-129F that is when you could apply for the K-2 for any children if needed but I am not 100% sure. Someone else might chime in but either way it is a moot point for you as you won't be using a K-2 as the child is a US citizen.

List ALL children on the G325A form. Later on the DS-156K form, for the interview, is where you would list any you want to receive a K-2 visa also. Very simple.
