Filing status on 2012 taxes

Timeline

Hello, I'm preparing to file my 2012 taxes to be able to include as part of the last 3 tax years i have to provide.

I was married in April 2012 and my husband lives in Mexico. He has no SS# or itin#.

I have called IRS and they said to file "Married, filing separately". Does this sound correct? Has anyone with the same situation filed like this?

It does sound correct. Because you ARE married, but because your husband does not have an SSN, you can't file with him--therefore, you are doing this separately. If you checked single, it would not be correct. Divorced, would not be correct. The only correct one is Married, Filing separately. Follow the IRS' advice. If you doubt it, maybe call another time :)

September 21, 2015 -- Mailed ROC Paperwork to August 6, 2016 -- Received Card in the Mail!

FROM NOA1 to GREEN CARD in Hand: Exactly 10 months 10 days! No Interview or RFEs.

Our {His} N-400 Process

Eligible to Apply for Citizenship on September 14, 2016.

October 4, 2016 -- Mailed N-400 Paperwork.

November 8, 2016 -- Completed Biometrics.

May 6, 2017 -- Received Interview Letter in the Mail.

June 8, 2017 -- Interview Passed!

June 16, 2017 -- Oath Ceremony! He is a USC!!

FROM Application to CITIZENSHIP: Exactly 8 months 13 days! No RFEs.

It does sound correct. Because you ARE married, but because your husband does not have an SSN, you can't file with him--therefore, you are doing this separately. You could file as jointly and get your husband an ITIN. Just remember that once he becomes a LPR he must file income taxes on world wide income. I would look at your tax situation and see which gives you the least amount of taxes paid--filing seperately or jointly.

If i file "married filing separate", do you know if i would be able to amend my taxes once he is in the U.S.? I'm not to sure how long it will take for me to get an itin number for him.

Timeline

You have until 3 years after the due date of the return, if I recall correctly, to file an amended return. Since the requirements have changed for applying and receiving a ITIN, you will have to file Form W7, along with a federal tax return unless your husband qualifies for one of the exceptions.

10/29/13: Hubby received email Administrative Processing is Complete

10/30/13: Hubby rec'd call from Consulate to drop off new medical and passport; Medical Completed

11/05/13: 2nd Sputum Done - 8 Week Wait Again!!!ranting33va.gif

01/17/14: 2nd Medical Done;Medical Report available for pickup

01/21/14: Hubby dropped off medical and passport. Consulate was closed on the 20th. Was told to pick up visa on Tuesday

01/23/14: CEAC Status says ISSUED

01/28/14: Visa in hand, paid USCIS Immigrant Fee

01/31/14: POE Houston, TX

03/04/14: Applied for SSN - Not in SAVE

03/06/14: Green Card Production

03/14/14: Received Green Card via Priority Mail

05/03/14: Received SSN - Had to wait for DHS verification

ROC

12/29/15: Express mailed I-751

12/31/15: I-751 Receipt Date

01/05/16: Fee cleared account
