Hello Guys,

I have a couple of things that i would like to clarify here. So my bro-in-law who is an American citizen is going to have a child in 2 months. His girlfriend is a filipino citizen and she lives in the Philippines and will be giving birth there. They haven't started the Fiancé visa yet. My bro-in-law will be in the Philippines during the birth but he would only be there for 2 weeks since his job only allowed him a 2 week vacation.

With the 2 weeks time, it would be impossible for him to process all the CRBA. Would it be okay if the girlfriend or his mother will process the CRBA in his behalf? with the power of attorney of course and he would have leave all proof of his american citizenship.

Is it really mandatory that the child will be brought to the embassy during the application? I think they really don't want to travel the baby that far yet. She lives in Mindanao, so it will be a long flight for the baby.

Is it going to be a problem given the fact that they are not married or haven't started the Fiancé Visa process yet? I don't remember what the ruling is in the Philippines, but will the child be able to have the Father's last name in the birth certificate even if the parents are not married? Ii would think so, but i'm not sure.

What are the necessary forms and documents that the father have to prepare in order to report the child's birth and to obtain the child's passport. What are the fees expected on this process? Do they need to call the embassy and get an appointment?

I really hope someone can help me or answer if not all, some of my questions.

The child can use the father's surname on the birth certificate, provided he signs an Affidavit to Use Surname of the Father (separate form) and the Affidavit of Admission of Paternity (at the back of the birth certificate). Don't forget to apply for ADVANCE ENDORSEMENT OF THE CHILD'S BIRTH CERTIFICATE at the Local Civil Registry so that you can immediately get an NSO copy of the BC, because if you don't apply for advance endorsement you will wait 6 MONTHS before you can get an NSO BC.

The child should be physically present at the CRBA application.

You apply for advance endorsement after the child is born. The child's mother can do this, she will have to go to the Local Civil Registry and tell them that she wants the BC to be expedited for she needs to have an NSO copy immediately. She can probably get an NSO copy of the BC within 3 weeks to 2 months, as against the normal processing time of 6 months.

If mom is giving birth in a hospital, they will provide the affidavit together with the child's birth certificate.

Either parent, including a non-U.S. citizen parent, may execute and sign this application. If it will be signed and executed by a legal guardian, a special power of attorney from the parent(s) or guardianship affidavit must be submitted. The application must be made before the child's 18th birthday and the child must make a personal appearance at the U.S. Embassy."

They are on the link(s) I provided, you need to read everything so you have a better understanding of the process. Two weeks is a bit young to travel IMO.

sjr09 provided you the links your brother needs in line with the CRBA of your nephew.

When I did the CRBA for my son, my fiance and I has not started my visa process - although I was asked by the consul about our plans.

My fiance was not with me and all I have are photocopies of the supporting documents - which needs to be notarized.

Safe would be tricky to determine.

Is it possible to bring the 2-week infant inside the airplane - yes.

It is advisable? - personally, no since the baby's immune system is not yet that good to ward of germs, etc.

with the rate of nso bc release - I don't think the 2 week infant would have the pertinent document at hand.
