Hi!

Thanks in advance for any guidance. I am trying to figure out how income in calculated for the I-864 and have two specific questions. 1) Is income looked at before or after taxes, or just based upon the adjusted gross income from federal Tax returns. 2) I am a graduate student and receive about $20,000 in fellowship/scholarship monies. Is this counted as Income?

For a K-1 you file a i-134, not an 864. Depending upon your embassy, they look at consistent income. Since a fellowship is not consistent, you may need a co-sponsor. They look at gross income or AGI on tax return.

1. Gross income before tax (line 22 on a form 1040)

2. Money for scholarships is not counted, it is dedicated to educational expenses

3. Stipends for living expenses or work related income (student teaching or assistantships) ARE considered income if they are verified with a letter from the school OR 1099s.

3a. Dedicated payments for housing are considered income
