The good news I am in NVC stage, where my AOS status already shows paid. However, here now comes another problem. After working for nine years with salary/W-2, the company bought out and on August 2012 I was rehired as an independent contractor by the new employer. I had no other option but to take the job offer. Now the time to file AOS has come and I am confronted with awkward situation. Although I have in hand my three years IRS transcripts for 2009, 2010, and 2011, and I don't think NVC requires 2012 tax return at this time around, however I am confused as to which form of AOS I864EZ or I864 to use in my situation. If I file I864EZ, I could only provide pay stubs that dates back to May, 2012. And the employment letter wouldn't be helpful either if it states as an independent contractor for the company in my current status? Now with paid AOS status I am really confused how to deal with the situation? I know the good people of this forum have been so helpful and dependable to me, and I please kindly ask your help. I just don't want get REF and what have you? By the way, my income is good enough. Please help me?? Thank you.

I am not a expert on this matter but I think you should just not make this more complicated than it has to be. There are three conditions for using I864EZ. If you meet the three conditions, you can file I864EZ form.

23-DEC-2016 -:- N400 form mailed to Dallas, TX Lockbox (USPS EXPRESS)

27-DEC-2016 -:- N400 form delivered/picked up by USCIS

01-JAN-2017 -:- N400 form fee check cashed by USCIS

04-JAN-2017 -:- N400 form received per NOA1

09-JAN-2017 -:- N400 form NOA1 notice date

14-JAN-2017 -:- N400 form NOA1 on hand through USPS

30-JAN-2017 -:- N400 fingerprint taken

01-FEB-2017 -:- N400 interview schedule process started

26-JUL-2017 -:- N400 interview date set (01SEP2017)

29-JUL-2017 -:- N400 interview letter on hand

01-SEP-2017 -:- N400 interview date - Interview passed

10-OCT-2017-:- N400 oath ceremony letter on hand (oath on 26OCT2017)

I am not a expert on this matter but I think you should just not make this more complicated than it has to be. There are three conditions for using I864EZ. If you meet the three conditions, you can file I864EZ form.

You are right, I might be complicating it a bit, but as you might well imagine it I just don't want get REF and I am just looking for second advice or suggestions if it is okay that, I file I864EZ since all my last three years taxes are based on single salary income and I have all the transcripts, except of course, 2013. However, as of last August, 2012, my status has been changed to an independent contractor, and I wonder if I could be qualified still to file the I864EZ? Thank and sorry If I am still making it complicated. I wanted to make it right. Once again, thank you.

Are you petitioning for only 1 person? (your spouse)

Are you using only your income to qualify as the sponsor?

Are you the one petitioner that filed the form I-130?

If you answered yes to all 3, you will use I-864EZ.

If you are sponsoring multiple people (children?) or you need a co-sponsor because you don't make enough money, then you cannot use the EZ form.

It doesn't matter exactly what your job is. You just need tax returns that show you make enough money to sponsor your spouse.

Thank you for the reply. I think you are right all should matter is that I make enough money to sponsor my spouse. and since my answer to all there questions are YES, I guess it should be okay to file I864EZ. I think I am going to do just that and hope for the best.
