Driver's License - Please help!

Timeline

My fiance arrived in the States on January 20th. We applied for his social security card and it arrived about a week ago. We made the trip to the DMV this morning for him to take his written driving test to get his Learner's Permit. When we arrived the guy at the DMV looked at his K-1 Visa which expired on Feb 24, 2006 (he was issued the visa in August of 2005). The guy at the DMV said that since his Visa was expired and since his I-94 is not valid for an additonal 6 months we had to wait until his status has changed over to Permanent Resident. In the meantime - he cannot apply for a driver's license at all. Has anyone experienced this problem or something similar?

Additionally, the guy said his K-1 visa, regardless of if it was expired or not, had to be valid for an additional 6 months from the issue of the drivers license. This makes no sense being that the only way he would have been granted a permit would have been if he left South Africa the day he was issued the K-1 visa and applied for a driver's license the very next day because the visa is only valid for 6 months as it is.

If anyone could please give us some guidance as to what can be done as far as obtaining a driver's license- we'd truly appreciate it!!

Well, I have this bookmarked. It doesn't make it especially clear what the rules are about expiration dates and such, but this at least shows what documents are supposed to be acceptable:

We are having the same problem here in Iowa. I finally called the state department of transportation office in Des Moines, and after about the 4th person we talked to there, were told that we could get a 180 day license. An alternative is to just drive on the foriegn license if you have one. It is valid until you get resident status. Unless it's expired, as in our case. Good luck!

-I aggree but some state would let u take a driving test/permit if u have the first NOA. I've been there done that my state wouldn't let me unless i have applied for aos and i have a receipt/noa so later on we came back with the paper and guess what?? they said i need a greencard first. They are not consistent.

Go to your dmv office if it's close or go online at www.dmv.org and find your state you'll see the requirements,phone numbers.

April 25,06 started working.

Aug. 18,06 passed the colorado driving test

Sept. 28,06 got my own car

Aug. 28,12 7th year wedding anniversary

July 11,2011 became a Citizen of US

When I got my DL in Colorado, I had to produce 2 government issued photo ID's.....which were my EAD card and my UK Passport. Maybe you could ask them if an EAD card would be sufficient rather than having to wait for the GC....just a thought!

In georgia, you can have drivers license if you have the EAD + Social security.

With an expired I-94 - it didn't work for me.. they said i had to wait until i got my EAD.

Feb 2005 - APPROVED for K1 Visa

June - 2005 - Moved to the USA =)

Apr - 2006 - APPROVED AOS Without Interview!!

Feb - 2008 - REMOVAL of conditions!!!!!

02/20/2008 - Package was sent to TSC.

02/25/2008 - Package confirmed received at TSC.

Luckily there was another lady there that said it was fine since we had brought his NOA from his AOS (I think the other lady was new) But we did have to have a SS# which we had
