Hi all,

My husband (from Spain) and I are in the process of gathering his paperwork to adjust his status. We married in the US a few weeks ago. I am confused about the I-864. While my current salary meets the income requirements, my most recent tax return (for 2011) is too low (I only worked part of the year).2010 and 209 returns are good. Because we're still in the beginning of 2013, my 2012 returns are not yet available. And even if they were, I did not work enough in 2012 to meet the requirements. I have an employment letter stating my current salary.

Question: 1. Do I meet the income requirements? I currently make enough but did not in recent years.

2. My parents are more than happy to be a joint sponsor. The do not live in the same household as me and my husband so they will also complete a I-864. But I read I shoudl not include a joint sponsor if I meet the income requirements (still unsure if I qualify). Also, in the household section, they are required to include the intending immigrant (my husband) but he does not live in their house.

Any advice is greatly appreciated!
