Hello, My wife got here through a fiancee visa. We got married last December 26. Now I am about to apply for adjustment of status for her. In the application for adjustment of status, can she use my last name now? Or she should still use her maiden name?

She can simply start using your last name as hers. My wife got her SS card in her married name before we submitted the AOS as I had read of USCIS messing with using the old last name as the middle name, I figured with the SS card already in her married name Philippine way they would have to follow suit.

oh okay.. thank you.. so my wife can get a social security card even we havent submitted the AOS yet? I was trying to look for that info but didn't read it.

Being your timeline is not completed I don't know when your wife entered the country - POE date, anyway the I-94 is only valid for 90 days and I believe you need 2 weeks remaining on that time to get a SS card without having to wait for your AP card or green card.

Hi!

I applied for my SSN after my marriage thinking that the SSA will put my married name on the card. However, they didn't.!.SSA still used my maiden name. They said that, they cant put my married name on the card yet since it should be the USCIS will change my name first.(eventhough i brought with me Marriage License). ( i do not know if every state has defferent issue on this case.) I am in North Carolina.

I recieved my GC and went to the SSA to change my SS card name from maiden to married name.

SSA is federal, has nothing to do with which state you are in... I would say you got an ignorant SSA person. We completed the SS-5 and turned it in with a copy of our marriage certificate and I-94, no issues, but then there shouldn't be.

Use the new legal name that's on your marriage certificate.good.gifWhatever new name she has on there is what your going to be using in filling up the AOS form.

Maybe you are right that I got an ignorant SSA person. lol. But anyway, maybe in two weeks I will have my New SS card with my married name on it.

Ya know - I'm gonna follow you - each time you write this stuff.

Why? It's #######. You're giving false hope to folk , leading them to believe that what worked for your wife will work for all.

It's not that way, at all.

You got exceptionally lucky. USUALLY, when folk apply in the married name (K-1 visa holders) within the 90 days on the I-94, a properly trained SSA staffer will send the stuff out for DHS Verification.

That was skipped, with you and yer wife.

I hope you realize how exceptionally lucky you were. I also hope that you stop repeating 'your story' as the gospel.

It's not the gospel. It doesn't work (mostly). You and your wife were exceptionally lucky, IMO bullying a SSA staffer to make it happen without the SAVE db lookup.

I ask you stop repeating your story, as it's not the way it's supposed to be done at any SSA office.

I applied SSN few days after I got her thru K1 visa. Then, after the wedding, I showed my marriage license and they changed it to my married name even before I submitted my AOS.

Lifting Condition (I-751)

09/09/2011 - Sent the package to CSC

09/13/2011 - CSC received the package

09/15/2011 - CSC cashed check and NOA1 Received

09/26/2011 - Biometrics Appointment Notice Date (Sent)

10/13/2011 - Early Biometrics

10/19/2011 - Biometrics Appointment

10/26/2011 - GC expiration

11/25/2011 - Received RFE

11/28/2011 - Sent response to RFE

01/13/2012 - Ordered card production (Approved)

01/19/2012 - 10 yrs GC received

Define "STUFF" !!

And then in your infinite wisdom... explain what information was the SSA personal pulling up on their computer when they "verified" information before authorizing issuance of the SSN for my wife.

And are you saying there is no "STUFF" sent out if a person applies for their SSN in the single name?

Here is some information to help you with "stuff being sent out to DHS, pay special attention to the right hand column where it makes reference to verification... especially how NO "stuff" is send to DHS but that the information is verified ONLINE - as the SSA personal did with my wife.
