Hi All,

I have an interview with the consulate in the next few days and I am a bit nervous. I was charged with assault by my ex-wife a few years ago. The charges were dropped and they do not appear in my police report. I have contacted the court in which the case was heard and got a copy a of the case which shows that the prosecutor with drew the charges. I have never had any police cases or issues with the police apart from a driving with a suspended license which was just a 200.00 fine which i accepted. This was due to a unpaid parking fine that I had forgotten about or loss.

I am really nervous that my visa will be rejected by the consulate due to the charges but was wondering if anyone can help. I have had a read of the rules that govern this and they seem to point to the fact if you had been convicted then you will not be able to but if you werent and the charges were dropped then there is a good chance you will. I have also looked at another site and they state that the US believe in the idea that innocent till proven guilty and if the charges are dropped then you are deemed innocent and should get your visa but I am still nervous and want to get peoples advice.

Thanks

You will be fine man just make sure you can show enough of a good reason to return to your home country. Show you have funds to support yourself over there and that you have a return ticket etc. They cant bar you for the criminal charge.

You should be fine, just write an explanation and attach a copy from the court that the case was dismissed.

You'll be fine. Make sure you bring a copy of the case summary from the court that shows the charges were dropped.

If you were arrested (sounds like you were), be sure to answer that question correctly on your application...
