Question 1:

My husband is filing a petition for me for permanent residence. We are kinda confuse in Affidavit of Support i-864 number 21. Household number. We are only 2. and he is only petitioning for me. it says ENTER

(a). Person you are sponsoring in this affidavit = 1

Person not sponsored in this affidavit

(b). you (his self)= 1

©. if you are currently married enter 1 for your spouse= 1

(h) Add together lines and enter the no. here= 3??? Household size

which one are we going to use? household size 2 or 3? we are only 2 but total is 3.

I don't know which poverty guideline are we going to use.

Question 2:

And one more thing, I am currently a F1 student in New york and He is a reserved active duty in Georgia. So until im not approved i cant live there yet cos i have to go to school and he cant stay here because he's in active duty there. But we try to see each other every month. The question is I will use his address in filing for all the forms cos eventually I will go live there. will it be a problem if they see we are not really living together? We will include proofs like joint bank acct, life insurance, affidavit of third party, and pictures tho.

Please help. Thank you!

Read the first line of Question 21. That's your answer.

21. Your Household Size - DO NOT COUNT ANYONE TWICE

Also, you're attempting to adjust from a student visa, not a family-based visa (i.e., a K1 or K3). There's a forum for that.

Duplicate topic has been merged and moved from AOS from a family visa to AOS from a Work, Student or Tourist Visa as OP is adjusting from a student visa

For Q 1: The total household size is 2 and the final answer is still 2. The point is you need to read a note before filling that form which appears right above that page stating about DON'T COUNT ANYONE TWICE. Thus you can fill "1" in (a) and (b). No need to fill in ©. Trust me, we did the same thing.

For Q 2: You can use the address you prefer to but you need to make sure that you can receive the Notice of Action (NOA) and each letter from USCIS on time and check your mail box often especially you read some NOA in your online status check. (You will get your case number after the application. To check the case, there is instruction you can follow). It will be kinda of issues if you and your husband don't live together. But again, don't lie and no need to hide anything from USCIS. Gather the evidence as much as possible and show to the officer when you have interview in future. As long as the relationship is bona fide one, you just take a deep breath and take it easy. Wish you good luck in visa journey.

Yeah, mail is also an issue cos he's in military so he goes training everywhere but his family is there so I guess i'll just ask them about that. We want to use same address but he can't use mine because of military issue and he doesn't wanna jeopardize that so we'll both use his address instead. Maybe copies of plane tickets could also help? Ugh hope everything works out.

I read I can add my income to hers. The fact is started the job this November 2012 . So how shd I go abt adding my income to hers and fill out the I864. .

You'll need to submit evidence of your income, IE paystubs, joint tax return, employment letter. You(foreign spouse living with primary sponsor) will fill out I864A.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

The intending immigrant needs to file form I864 A if and only if the intending immigrant has accompanying dependents. But in my case, i dont have one. So is it necessary to file is this form I864A even if my wife fills out the form I864.
