Hello Everybody!

I'm just about to file my AOS paperwork and have a small dilemma. I entered the USA on a K1 on August 18th,got married October 7th. My 90 days (I-94) expires on November the 18th.

I have an appointment with my local civil surgeon on the 14th of November to try to get my I-693A completed. My worry is this - do I have to have the AOS paperwork submitted before the 90 (upon arrival) days is up?

By the time my I-693A is completed (assuming I can persuade the surgeon not to do a full medical) and get the forms in the mail, the paperwork package might not even get opened at the USCIS until after the 18th. I COULD submit the forms right away, but only including the DS-3025 vaccination worksheet I got in my London medical - but I understand I am risking an RFE by doing this. All of my vaccinations were up to date at the London medical.

I guess I'm asking "what is the lesser of the 2 evils" - submit the AOS package with the vaccination worksheet (DS-3025) or submit after the 90 days is up, but with the I-693?

If anybody has any thought, I would be eternally grateful!

Many thanks,

Paul

No, you have to get Married within the 90 days, not submit the paperwork.

I sent in the worksheet I got from London, I know a lot of others did this also. I have my fingers crossed that I do not get an RFE on this.

You didn't ask right away, if they can just transfer the information from your DS-3025 to the I-693A form? I needed about 6 phonecalls to find a CS, who didn't want to talk me into taking a complete medical, then I talked to 3 who were willing and I then picked the one who was the cheapest. Besides.... all of them offered me to just stop by the next day.

To avoid any delay you might wanna call other CS's to have at least another choice, if this one refuses to just transfer the information.

It is NOT necessary to file AOS within the 90-day period... as long as you got married before the expiration of your I-94.

I submitted my AOS application ONE MONTH after the expiration of my I-94, but got married before the expiration date. It's alright... I have my greencard.

When I submitted my AOS application,,, I did not include the I-693A because I didn't have time to go to a Civil Surgeon. I did not receive an RFE at all.

After submitting my AOS application, I visited a CS and had my vaccination(anti-tetanus),,, and gave him the copy of my medical examination from my country(before my Embassy interview), and so the CS copied information into the I-693a and completed everything. During my AOS interview, I brought my I-693A and the Immigration Officer didn't even ask for it. lol I initially gave it to her(IO)... No problem at all.

Don't worry, you'll be fine.

Godbless!

I'd be the Mrs. :D Paul did ask right away but the umm, witchy receptionist informed him that they 'don't do it that way'...you know the type. Little bit of power...absolutley no knowledge. You run into those people often in this process. SO we're trying some other ones. I'm guessing quite a few will be the same answer, just like your experience. Some due to plain stupidity, some due to that ol' 'doctors are Gods how dare you expect them to just pop out of the office for five minutes and write something with out a full appointment, history, etc' attitude you often get from the staff and some because it's a real quick way to score some cash on a full medical fee.

10/07/2006 WEDDING DAY!

12/02/2006 Paul had biometrics

12/14/2006 AOS Forwarded to CSC AND AP Application approved.

01/17/2007 First touch of 2007 at CSC

01/20/2007 Touched AGAIN (also the 18th) come on...

February: Oops, RFE for a REGISTERED marriage certificate. Oops! Overnighted it.

02/28/2007 Paul gets email letting us know his GREENCARD is on it's way! It's done...for now!

03/09/2007 Paul's greencard arrives. And breathe...

We began with mailing the I-129 in on February 27, 2006 so the whole process took us approx. one year.

Good luck out there!

I called the USCIS help line back when we filed, to find out whether the vaccination supplement was required if all the vaccinations were taken care of before the K-1 consulate interview. The (very polite and helpful, actually) guy on the help line told me no, that the vaccination supplement is really meant for people who don't have some of the vaccinations readily available in their home country, and as long as the vaccination record was included with the medical stuff in the packet at the embassy (the mysterious brown envelope that was given to the officer at the POE), there's no need for the supplement at all.

I wrote a note with my husband's AOS packet that said that all vaccinations should already be included in his file, and so far, no RFE! (Well, we did have an RFE, but it had nothing to do with my husband's medical records.)

Your mileage may vary, of course, but this is my understanding.

Conditions Removed! Ten-year green card received 6/24/2009. No more USCIS for a very long time.
