Hello:

When my fiance went to the interview, as indicated in packet 3, he took the form I-134 (Affidavit of Support). However, they said he needs Section (a)(4) which prohibits the issuance of a visa to anyone who will be a public charge.

Anyone has an idea of what I have to submit to indicate he is not a public charge? I submitted income taxes, letter of employment, bank statements, check stubs,etc.

Do I have to complete another form?

It's not that he "needs" Section (a)(4); in the consular officer's judgment, he did not demonstrate that he meets the requirements of INA 212(a)(4). That means one of two things: they didn't like your evidence, or your income wasn't high enough.

With regard to the evidence, the list you provided sounds pretty thorough. Did you submit income tax transcripts or just copies of your returns? Transcripts obtained from the IRS carry more weight because they prove you actually filed and didn't just fill out the form. Info on obtaining transcripts: http://www.irs.gov/I...er-a-Transcript

Improved USCIS Form G-325A (Biographic Information)

Form field input font changed to allow entry of dates in the specified format and to provide more space for addresses and employment history. This is the 6/12/09 version of the form; the current version is 8/8/11, but previous versions are accepted per the USCIS forms page.

This sounds like a denial. Did they keep his passport? Did they say he must find a co-sponsor?

If you want post a detailed description of what happened at the interview and we may be able to help. But, with this information, it sounds like they denied his visa. I may be wrong though.

Don't ever do anything you're not willing to explain the paramedics.

It looks like you have submitted everything that seems to be cover for the I-134, the only thing i could see is that you are not making enough or below poverty. Pls share more information as you can get more helpful answers..

It looks like you have submitted everything that seems to be cover for the I-134, the only thing i could see is that you are not making enough or below poverty. Pls share more information as you can get more helpful answers..
