Hi All,

I have filed my N400 on September 2012 and waiting for my Interview Appointment Letter. Recently, after going through posts on this forum, I think I did not answer Part 10 Section D Question 16 Correctly.

16. Have you ever been arrested, cited, or detained by any law enforcement officer ( including USCIS or former INS and military officer) for any reason?

I have two tickets: Speeding and Disorderly conduct. Both went on City court hearing and both cases were dismissed. Since, both case were dismissed and I was not charged any fine, I thought I can mark "NO" on above question. I will definitely mention about this in an interview and I will be honest with an Immigration Officer.

Reading other posts, looks like I should have mentioned "Yes" and should have written explanation about it. I am in dilemma, Did I answer correctly? will it cause problem at my interview?

Wife's CR1 Visa Journey:

Feb 17, 2012: Mailed I-130 Petition.

Feb 20, 2012: Received NOA 1 ( Priority Date Feb 18, 2012).

July 12, 2013: Requested USCIS to Upgrade petition from F2A to CR1.

July 27, 2013: USCIS sent confirmation email regarding upgrade.

July 29, 2013: I-130 Petition Approved dancin5hr.gifwow.gifdancin5hr.gifstar_smile.gifsmile.png

August 02, 2013: NOA 2 Received.

August 12, 2013: NVC Received the Petition

August 29, 2013: NVC Assigned the Case Number

September 4, 2013: AOS Bill Invoiced.

September 4, 2013: NVC requested to fill DS-261 via email.

September 4, 2013: Filed DS-261 online.

September 4, 2013: Paid AOS bill online.

September 6, 2013: NVC Accepted AOS bill payment.

September 6, 2013: Mailed I-864Ez to NVC

September 11, 2013: NVC Entered AOS Documents into their system for Review ( NVC Says it may take 30 business days to review)

September 16, 2013: IV Bill Invoiced.

September 16, 2013: IV Bill Paid.

September 17, 2013: NVC Accepted IV Bill Payment.

September 19, 2013: Filed DS-260 Online

September 20, 2013: Mailed Civil Documents for IV application

September 23 ,2013 : NVC Entered Civil Documents into their system for Review ( NVC Says it may take 30 business days to review)

October 1, 2013 : NVC Accepted AOS. smile.png

October 17, 2013: Case Complete smile.png

October 28, 2013: Interview Scheduled wow.gifdancin5hr.gif

December 11, 2013: Interview

December 26, 2013: Visa Received

January 4, 2014: POE, Chicago

I had 2 tickets and I answered YES

some say that I should answered NO,because it is not a major offense

my advice is just bring the tickets at the interview.

It should work out. Does the dismissal order state the content of the tickets and the ticket numbers?

Take all documents that you have with you to the interview in case the officer asks for them. You can never have too many documents with you.

Hey formywife:

My friend got DWI . He got arrested for hit and run but the court dismissed the case becaus he accept his fault . He applied for naturialize got interview and approved couple months later. It's best to tell USCIS employee upfront . Also, please bring all your court dismisses document for both of the case because they will review it. His case he got approved but they did not give him naturialization ceteritcate until couple month later . It's just normal process they will called the court to verify if its correct .I believe speeding is misdemeanor offense so its wont hurt you at all.

At the interview, the I.O. will go through your entire N-400 application to make sure you didn't make a mistake. That's the time when you will correct it, verbally. Only when you leave the interview, the music stops.

For a traffic violation free of driving under the influence, assuming alcohol, under $500, you can answer no, instructions say so. But your IO can ask you if you had any violations, including a parking ticket and may demand you show proof you paid that fine. This will cause a delay in your processing. Speaking from experience on this from a small fine that was over four years old when my stepdaughter was still a minor.

Told her she did have proof just by showing her drivers' license, if you don't even pay a small parking fine, our state will take that license away.

Disorderly conduct is yet another matter, that should be reported regardless of the outcome. Would definitely make that correction at your interview and bring along your paper work.
