how to withdraw an application

Hi, I know this is an old thread, but I need to know how to withdraw an application. Basically, I just want our photos and documents back.

Our interview was in 2010, and was denied stating that we needed to submit a waiver, which we never could because we couldn't find out where it was supposed to go (and USCIS kept sending it back saying to send it to another office, which told us the same thing).

Anyway, there has been no activity with our account since then, so the application is dead in the water, and I want my stuff back.

Any advice is appreciated, thanks!

All Materials Received by NVC: 2/16/10

Interview Assigned: 4/15/10

AVR updated-Case forwarded to Montreal: 4/16/10

Medical in Toronto (Passed!): 5/10/10

Interview in Montreal: 5/20/10 -Nope, she refused to accept my '09 taxes, said we have to mail them in.

Forget it, I'm moving to Canada! ?/?/10

Ok...I might wait until next year to move. Something could happen...right?!!!?

Withdrawing a petition is one thing, but if you sent them original photos and documents, I don't think they'll ever give those back to you.

It's water under the bridge for you now, but for the benefit of future readers, never send USCIS your only copies of anything. Send photocopies or duplicate photo prints only. If they need to see originals they will ask for them at the interview.

Exactly correct but it won't hurt to try. You can send a letter to withdraw your petition and in the letter, you can ask for any original photos or documents. Only the official forms should have been originals to USCIS but the couple would have submitted original documents to the Dept. of State prior to or during the interview.

Facts are cheap...knowing how to use them is precious...
