Good morning all,

I am in the process of filling the I-129f form; however I have a couple of questions. I know I have to provide an affidavit stating that I will be able to sustain us both while her USCIS paperwork comes through.

She is from Mexico City

I currently live in Los Angeles, CA and my annual net income is $19,350 (gross income being $22,000).

I'm in the processes of being promoted to a better pay grade but this could happen between now and the next 6 months which could be too late for me.

My question is:

Would my current income be too low and potentially could she be denied because of it?

Thank you and I will appreciate any feedback.

You will be using your gross income, but the poverty guideline to adjust status for 2 people is $19,200. It is higher than the I134 guideline, so you will be ok.

Thanks for the help.

I have another question?

I only began working full time until June of this year.

And last year made less then the required $18,912 HHS poverty guidelines.

Could this possibly affect me?

Thank you

You could attach a letter from your employer stating / your full time status, salary etc. but your tax from 2011 is what it is. You can always have a cosponsor as a backup. Or it is almost the end of the year file early then apply and use new figures.

In Arizona its hot hot hot.

Has anyone had positive or negative experiences at the US embassy in Mexico City?

What could solidify my stance on income? I'm confident but I also understand that they could deny her the visa and I want to avoid any possible missteps.

Any advice?

Thanks

You don't need to submit any financial information until the interview. If you income at that time is sufficient, then it is sufficient. If not, then you need a cosponsor.

As long as you meet the minimum requiremet then it should not be an issuse. Also you mentioned a raise in 6 months. Thats at least how long it will take through this process before you have an interview. So at that point at the interview if you have your raise you can bring in paystubs that show the new income along with a letter from employer that states its a full time and permanent position with new annual income. Also make sure you have your tax transcripts that you can get from the IRS for free for 2012 and 2011.

Just so you know any I-130 or I-129F in the country of Mexico goes through the Ciudad Juarez Consulate. So you should prepare to pay for flights from Mexico City to Ciudad Juarez once you are given an interview date.

Hi I recently filed my I129f and wrote on my form for the consulate in Guadalajara. IS there a difference? Why does everything have to go through Ciudad Juarez? IS there a problem if I wrote down Guadalajara?

I would call the USCIS and see what they say. They may send a RFE for it or hopefully the ajudicator will forward it to the right place. If you look up the Guadalajara Embassy website you will see what types of visas they issuse there. K-1 and I-130 will not be on the list. Its only on the Ciudad Juarez Consulate list. I have no idea why they chose to send all those types of visas to Ciudad Juarez ( one of the most dangerous places in Mexico) but they did that years ago. Guadalajara is mostly for tourist and work visas. I would have lived for them to have processed it there for my fiancee but its just not possible. A tip- once you get an interview in Juarez stay at Microtel or Ibis hotels. They are 3 min walking distance to everything
