My "over a year old" I-129F petition is being denied by US Consular in Euroup. I have visited and seen my Fiance twice. She was interviewd and asked very detailed questions including where we first met. She told at Church and I told them we were neighbors. Difference in answers.

Here is what they send her:

"After careful consideration of your case, we have forwardedthe application to the Buerue of Citizenship and Immigration Services (CIS) ofthe Department of Homeland Security (DHS) for a decision on possiblerevocation.

Section 221(g) of the Immigration and Nationality Act (INA)prohibits a consular officer from issuing a visa to an alien if the consular officer has reason to believe that the alien is ineligible. Based on indications that approval of petition STKxxxxxxxxxx was obtained by unlawful means, we are returnig it to CIS for review and possbile revocation. If CIS determines that the information obtained by post is sufficient to initiate revocation proceedings, that office will send you a notice of intent to revoke, including a statement of the facts and evidence, and you will have the opportunity to respond. Under INA 222(f) which addresses the confidentiality of visa records, we are unable to provide any further details."

What do you advise me to do?

Appeal I-129F when denied?

Should I go and marry my Fiance in her country and come back and start a new application for K3 Petition or I-130 application?

Is your fiancée not originally from Stockholm or Scandinavia, in general? Do you know what type of detailed questions they asked? Stockholm seems like it would be pretty low-fraud, otherwise. :unsure:

If you weren't at the interview, you should first get all the details on exactly what happened. Filing an appeal likely won't be a good option, especially if the CO felt there was something fraudulent about the case.

Is your fiancée not originally from Stockholm or Scandinavia, in general? Do you know what type of detailed questions they asked? Stockholm seems like it would be pretty low-fraud, otherwise. :unsure:

If you weren't at the interview, you should first get all the details on exactly what happened. Filing an appeal likely won't be a good option, especially if the CO felt there was something fraudulent about the case.

I am naturalized US citizen. My Fiance is a permanent resident in Stockholm. I was not at the interview. They asked her detailed background questions at the interview. Then, they called me at 5:00 am US time (I work until 2 am 2nd shift) and I don't know what I answered. There is a little language barrier. The main difference was where we first met back home and what day !. There is nothing fraudulent about the case.

Does an appeal seem a workable option?

Should I just fly to her and marry her and come back and start I-130 petition?

Not enough info to judge. Are you an USC? In which country were you neighbours?

My advice is to wait for a letter explaining the refusal.

Because you both did not provide the same answers, they deemed it as an application for immigration purposes.
