Sorry, I just bumped it so I could find it easier. I was on here and had to leave in a hurry.

Instead of bumping threads, you should go to the upper right corner of the screen where you will see your username. Click on the arrow next to your username for a drop down menu to appear. In that menu, you will see "My Content" as one of the options, click on that option and it will take you to all the threads you have started and posted in.

Our journey:

September 2007: Met online via social networking site (MySpace); began exchanging messages.
March 26, 2009: We become a couple!
September 10, 2009: Arrived for first meeting in-person!
June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!
June 21, 2010: Engaged!!!
September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

July 23, 2025:  Filed N-400 online

I have been asking questions on www.justanswer.com and the expert on immigration after I had asked if going back to America would resolve the is you. She said yes and getting a job while there would help too. Then I followed up asking if that was necessary and she confirmed that as well since I have been in China for seven years with some trips home.

What do you guys think?

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

Ok, thanks for all the advice. I'd like to get this done even if it means preceding my wife to America. I'll definitely check out that link.

To their credit they didn't seem to misunderstand the law. They seemed to be telling me what would be a near guarantee to resolve the problem. I was the one who brought it up. They felt the note from my mom wouldn't prove much and that I should get a three month lease at some corporate housing in my area.

We have some friends who just brought their maid/friend to America and they used a lawyer. It cost them $700 but a lot of that was fees for filling out forms. He seemed to know the consulate very well telling them what her chances of success were. (He said 85% chance of success on the 2nd visit and she got the visa) I went ahead and sent him an email outlining my wife and I's situation.

Do you think that going back first is overkill? I am willing to go back to the states first, but I don't prefer it.

Keep in mind that I've been in China for 7 years and have gotten two OF-194's already.

I think your latest response will be sufficient. If it turns out not to be, you can always take the next step by going back and actually establishing domicile.

Facts are cheap...knowing how to use them is precious...

I think your latest response will be sufficient. If it turns out not to be, you can always take the next step by going back and actually establishing domicile.

When corresponding with the embassy whoever sent me an email said when we send back this packet they will make a final decision. According to the OF-194 if a fail to convince them of my reestablishing of domicile they will reject me as the petition and change send another one, but instead of domicile the complaint would be "public burden". I just want to make sure we have a really good chance of passing before we move on in the process.

When you leave out critical information about your case, you can count on unreliable advice. Based on the above, send evidence you've actually moved back to the USA and established domicile there.
