I'm getting a bit confused with all of these co-sponsorships. I don't need to fill out any of the I-864s but it's just my curiosity that's all.

Please note that this is just for K1 and these are the circumstances.

1. USC did not meet 125% Poverty Guideline with a co-sponsor, not in the same household, which form(s) to use?

2. USC did not meet 125% Poverty Guideline with a co-sponsor, in the same household, which form(s) to use?

3. For AOS, USC did not meet 125% Poverty Guideline with self-support spouse (if there's such thing), which form(s) to use?

When does I-864EZ and I-864W come in to play?

K1s usually use the I-134 for the visa interview, and the I-864 only for AOS, but some embassies want the I-864 from the start. So to answer your questions...

1. I-864 for petitioner, I-864 for the co-sponsor

2. I-864 for petitioner, I-864A for the co-sponsor IF they are financially dependant (not just people who happen to live in the same house).

3. As married now, the USC and foreign spouse can combine money on the I-864. The foreign spouse can't work in the USA yet, but can use any US based assets.

I-864EZ is for if you have a very straightforward salary, no assets used, no co-sponsor etc. I-864W is for a chil;d that will become a USC upon entry (such as child of a USC whop didn;t have the physical presence requirements for CRBA.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Depending on the embassy an I-134 can be filed instead of the I-864. Now to your questions.

#1 The I-864 is filled out. One by the sponsor/petitioner and one by the co-sponsor. Incomes will not be combined with this form.

#2 The I-864 is filled out by the sponsor/petitioner and the I-864a is filled out by the co-sponsor. Incomes can be combined. It has to be a relative that lives in the same household, or the sponsor claimed them on their taxes if the do not live in the household as in a sibling, child, parent.

#3 The I-864 is filled out and same steps in 1 or 2 apply depending on your situation.

An I-864EZ can not be filled with a k1 visa as this form states in order to qualify for it's use ALL Conditions must apply which refers to the filling of form I-130 which you are not filing if doing a k1 visa. Also there can only be one person listed on the petition.

And as far as filling the I-864W the intending immigrant has or can be credited with 40 quarter of work, will acquire citizenship upon admission under section 320, or is the self petitioning widow (er) or qualifying battered spouse or child.
