Hello there I am an Italian guy married with an American Citizen.

I came in California on a Fiance Visa on October 30, 2009. On November 25, 2009 I got married. In January 2010 I filed my petition to change status. In July 2010 I received the green card as a conditional resident. On April 2012 I wrongly filed the I-90 form to renew my green card. On July 2012 USCIS informed me that my request had been denied. On July 2012 I visited the San Francisco USCIS office where I learned that I had to file the form I-751 to remove conditions of residence. After sending all the requested documents along with the I-751 on August 2012 I received the I-751 receipt note in which I had been informed that my conditional resident status had been extended for a period of a year. I visited again the local USCIS office to see what I could do to finally remove the contions of residence. They told me that I don't have to do anything as I will be called to have my biometrics and fingerprints taken and they could not estimate when it would have happened. If it took more that a year I should go there again with my Italian Passport and they will stamp on it a kind of a visa, I could not understand well as the workers there are pretty nasty, which will extend me for another year. Is it that true? I would like to avoid that. I also asked if I could file the petition for the naturalization as being married with my wife for 3 years by now. They replied that it is better to go step by step and wait until my conditional status of residence has been removed.

I am sorry if my statement is not clear enough.

Do you have any suggestion or clue on how to proceed?

Hey Fabio,

I am currently also in the ROC process.

The note you received (NOA1) is proof that your conditional green card is extended for one year. You will get another notice with your biometrics appointment soon (I think it only took a few days for me).

The wait for ROC is currently pretty long, I believe upwards of 8 months. As you have the extension, everything is fine (to work/to travel) and all you can do is wait.

I do believe that you can file the forms for naturalization after 3 years of marriage. You don't have to wait for the 10-year green card, if you don't want to.

it's not only 3 year of marriage, but also you have to be a resident for 3 years.so 90 days before the 3 years is the earliest you could file for citizenship. if you got your GC in July 2010, probably April or May of 2013 you would be able to apply. maybe you will have your 10 year GC by then
