Hello,

I have got many questions to ask here. I hope you guys can help, it will be greatly appreciated. I got married last year and I am a US citizen filling for my husband (Indian citizen), who stays in UK from past 4 years. I have completed the early steps for process, but now stuck with other issues. I received an email a day ago from NVC; they sent me a huge checklist of documents which are needed to resubmit.

1. Since my husband is in UK from past 4 years, he obtained an Indian police clearance certificate (PCC) from Indian Embassy, UK. However the USPS lost our mail containing the PCC. Anyways we are trying to get another one from India (as he is leaving UK in 3 weeks, he doesn’t have that much time for the process (~45days)). He also obtained a Police clearance certificate from the local police department, UK. My husband has lived in many cities of UK from past 4 years (Portsmouth, Bristol and few more), so my question is does he have to obtain police certificate from each of the city he has lived or the one he obtained from the current city is fine?

2. I am a student and do not work, so my parents are the sponsors. My dad has filled i864 and to the meet the income line my mom is asked to fill out i864a, so do I have to fill out i864 too?

3. NVC has also asked to submit birth certificate and marriage certificate along with 2 photos of the applicant and passport copy. I had already submitted these along with I130 at the beginning, I called them yesterday and said that I sent these documents already, and the representative said she will ask the case worker to review my fail again for that, what would you guys suggest shall I still send it or wait for their reply after revision of the file?

All your help will be greatly appreciated.

hello there i can help you regarding UK police certificate,coz i been passed through this process,he is still in UK for 3 more weeks so it means he have more than enough time to get UK police clearance certificate from UK.he dont need to go each and every town or wait 45 days coz for immigration purpose he need only one police clearance that covers whole UK including northern ireland that is called ACPO police certificate,and that is only for immigration purpose so you need that certicate not a local one.you can get urgent in 2 working days fee of 80 pounds and standard 45 pounds in 10 working days...so please make sure to get ACPO certificate for immigration purpose....i hope this will help you if you need more information dont hesitate to ask me.....

With I-130 there was no need to submit original documents (like marriage certifcate and birth certifcate.Anyway you ask NVC that you already submitted these documents.Mention whatever you submitted in an application which i pasted at last.

However, you have to fill I-864 even you are student.

When you will submit documents to NVC along with Fee make sure you should submit as follows:

1-Husband Original Birth Certifcate(and its english translation if it is in Hindi!)

2-Original marriage certifcate (and its english translation if it is in Hindi!)

3-Husband photos 2inchX2inch with white background =02 nos

4-Filled DS-230 form

5-Husband Passport copy

6-All PCCs (orignal)

7-I-864 which your father and you will fill out seperately

8-Your father most recent income tax return.This income tax return will cleraly reflect that you are dependent on your father.

9-Your US passport copy

10-Attach one application as follows which will work for you:

Dear NVC Representative:

My name is xxxx. My case number is xxxxx. NVC has sent me a letter requesting an I-864 because I am the petitioner. My father is main sponsor who is sponsoring my husband. I have never filed tax because I have been a student. I do not work and I am dependent on my father. I am sending you the I-864 under my name and I am attaching my father’s recent tax return on which I am listed as a dependent. If you may have any further questions please contact me at (your email ID) and/or PH NOXXX.

Question#3- I hope you didn't submit originals. But You have to sunbit originals of His Birth certificate (not yours), his wasn't needed at USCIS and Original or certified copy of original Marriage certificate. Also his passport pics (2 of them).
